Legal Advice needed [hotlinker]

Hello all

A mainstream client who refuse to pay me for months for a website he had me rework from a former company (his employee) is now hotlinking the site in an iframe from My server..

In a nutshell :
  • Company A (Roofing) ask me for a website (CompanyA.com), I do it, make it live and invoice them...
  • Company A goes bankrupt, the boss goes to work for a new Company (Company B)
  • Company B (Roofing as well) ask me to change the A site to make it look like B (CompanyB.com) (change of logos, address,etc...) and they will pay me Company A's invoice. I do it and make it live and invoice them...
  • Now I'm trying to get paid from Company B for months. Always supposed to call me and have a meeting. Blah blah, BS ...
  • I didn't wanted to shut it down, cause that would be kinda sign of 'I give up'

Now I just discoverers that CompanyB.ca is hot-linking my CompanB.com site from my server. PLUS the internet company who did this (the Iframe) have the nerve to put a Copyright notice with a Conception by : TheInternetCompany.com...

Can I sue their ass off Company B and Internet Company ? I'm willing to hit them hard. Wasn't really mad and expecting anything, but now they crossed the line...

Yeah, just block it.

To sue someone, you have to prove monetary damage. How much $$s are you out for the hotlinking? Go ahead and sue for the unpaid website bill, but I don't see how you'll get anything for the hotlinking.

Or make an html page and say something like...

If you would like to file a complaint against Company A or B or the individuals xxx xxx please do so here. They do not pay their sub-contractors.

Give them a list of gov agencies to file complaints against them.

In the US you can have a contractor investigated and if he is in fault, have his license pulled or fined.

Change the images and other things that are being hotlinked to a random picture or black bg with your website watermark using .htaccess

What I would do would be:

1. find out what ip their company uses to access shit. It will usually be a single block of ips.

2. Through a script into the page that when it is hit from one of their ips shows the page they are expecting.

3. When it is not one of their ips show a different page, perhaps with the story about how they are ripping you off, or extolling the virtues of one of their competitors or whatever other fun things you could think of.

It can be wonderfully fun when people give you control of their content by hotlinking.

I had a guy hotlinking some of my images from a mainstream site I have to his roofing business website. I just swapped them out with goatse.jpg

Took him a few days to figure it out...I'm sure his customers wanted to know why he had a guy pulling his asshole wide open on his homepage.

LOL Looks like Roofing companies are all crooks

For the record, The have the Money, and I don't want to sue them for the Hotlinking, but for an overdue invoice for Design, Development & Hosting (1 year). About 6Gs...

the hotlinking has nothing really to do with the money the client owes you. hire a collection agency - if that doesn't work, sue. the hotlinking evidence can't hurt but you really don't need it if you have the documentation to back up your claim of non-payment.
