    need records even if we promote affiliates ?

    We all know the affiliate programs need the records to individuals need to be 18 and over...but what about the other guys that re-broadcast this on other sites ?

    I just noticed this 'wording' regarding the Tumblr purchase, and it kinda got my attention. We need these records too even if were promoting affiliate programs ?

    But the law doesn't just apply to people who shoot adult content (also referred to as "primary producers"), it also applies to people who upload and distribute adult content (known as "secondary producers"), who are expected to maintain their own records--or, at the very least, maintain a list with the location of the records that apply to the content they're showcasing. Not maintaining these records is considered a federal offense--even if everyone in the content you're distributing is above the age of 18.

    I am thinking, if you know where you get your content, you are fine. Like if you build a gallery using pimproll content, You would refer any question to the DD257 page for pimproll.

    I really wouldn't worry about it though. Look at all those tubes that let people upload whatever they want.

      Yeah, if Tumblr pinched users for posting 18+ pics without records they'd have to kill 70% of their site.

        good points, i'd think (and hope) they'd go after the 'big fish' first anyway....if they did think about being 'anal' like this... like said, so many sites redistribute legit porn.

          It would probably be pretty great for producers and affiliates if Tumblr and reddit etc. actually policed that stuff.
