The Bloomberg-backed city Board of Health approved the regulation last year, calling it a crucial tool to attack obesity. The rule forbid restaurants and certain other businesses from serving sugary sodas larger than 16 ounces.

In striking down the regulation, Tingling noted that the rule would have applied to all food-serving businesses regulated by the city, such as restaurants and movie theaters ? but not to state-regulated establishments, like 7-11 convenience stories.

?The loopholes in this rule effectively defeat the stated purpose of the rule. It is arbitrary and capricious because it applies to some but not all food establishments in the city? and because it applies to some sugary drinks but exempts others, the judge said.

It's amazing the fucked up shit they'll try with good intentions. This is a case where you can't put the shit back into the horse. People are going to drink unhealthy beverages and eat unhealthy food until the healthy options are at least equal in cost and taste, which I doubt is ever going to happen.

The judge ruled against it because it was "capricious and arbitrary". You couldn't buy a 17oz soda in a restaurant that was regulated the the NYC Board of Health, BUT YOU COULD buy a Super Big Gulp at 7-Eleven because they are State licensed. Totally arbitrary, totally moranic. December 31, Bloomberg's last day in office, can't come fast enough.

Yeah it makes no point .The point it does give thought to is, people are getting fatter and fatter drinking huge sodas. There is a good chance they get sick we are all going to pay for them.

bloomberg is just trying to make it so only rich people want to live here. Pretty terrible. Just to commute around NY now costs an arm and a leg. The tunnel from Brooklyn to Manhattan is $7.50 each way. 14 dollars just to go back and forth. You can technically go for free on any of the bridges if you want to drive for an extra 30-40 minutes.

i dont know why bloomberg cannot regulate the size of sodas. the government has assumed so much power & regulates everything, i no longer see how a judge can say the government cannot do it.

it is an LOL, however, that a restaurant cannot sell over 16oz but a grocery store next door can.

if your gonna use the law to push people to healthy, this is hardly a meaningful step. just stupid all around.

Well, we pay for a lot of people's bad choices. For the vast majority of cases, HIV is preventable if you use a condom or don't share needles. Yet people still do it, HIV is contracted, and a lifetime of expensive meds are needed.

Should people who abuse alcohol not receive treatment for the destruction that causes the body. How about smokers?

The list goes on and on. We could put people in special camps to stop them from doing harmful actions. That's at the other extreme of the spectrum of government telling you what you can and cannot do.

Every journey begins with a single step - which is why I was very happy the Judge ruled that Bloomberg's was a misstep, not to be taken.
