    Brazzers is shooting in Las Vegas...

    ...which I don't suppose is news to industry insiders. But Brazzers might want to consider a couple things--like shooting porn in Nevada in general and Las Vegas in particular is not legal. And because of that shipping porn girls from CA to NV to shoot scenes might be considered a violation of the federal Mann Act, aka the White Slave Traffic Act (more here: http://en.wikipedia.org/wiki/Mann_Act).

    They also might want to consider forbidding talent from posting anything on social media about shoots. Several LA companies are already doing this with the threat of cancelling the shoot if this rule is broken. The business (in LA, at least) is halfway to being underground again, though I guess Brazzers didn't get the memo.

    This is what I'm referring to: https://twitter.com/Lola_Foxx. Go down her Twitter feed and there are multiple references to "shooting in Las Vegas for Brazzers" and being at Burbank Airport, etc.

    Is this a smart thing to do with all the harassment the business is getting at the moment?

                          The Aide Healthcare Foundation (AHF) has hundreds of millions of dollars, is very organized and will stop at nothing to get condoms in porn.

                          I know this firsthand as they targeted me and as you may be aware I am condoms only for my productions.

                          Once AHF start turning companies in places like Nevada and Florida for shooting without permits, condoms, insurance etc.. they will be prosecuted by local law enforcement agencies that have no experience with the adult industry. They will also be investigated by Federal OSHA.

                          I am not saying this a doomsday scenario, but I would not want to be arrested in Florida or Nevada for shooting porn without condoms.

                                          There's a difference between saying something *will* happen and the possibility that it *could* happen. No one can predict the future, not even Porno Dan. You might consider the fact that you were targeted for attention that brought you trouble like many the other producers in California who have gotten targeted in the past by law enforcement and other governmental agencies because you make a lot of noise and stick your head up and practically ask for it. John Stagliano, Max Hardcore, Rob Black, TT Boy, Ira Isaacs and many others have learned that lesson and they all produced porn exclusively or mostly in California, the primary state where it's legal. Unless your movie is considered obscene of course, which could be applied to even the most vanilla sex movie. Historically, California is the state that is by far the most risky to shoot porn, not the least risky.

                                              The nature of my business requires me to 'stick up my head', after all I do shoot live on the Dish network eight times a week.

                                              Yes, California has had the most investigations, but then again the vast majority of content produced was shot here.

                                              I personally know Michael Weinstein, the President of the AHF, a I served on sub-committees with executives of his organization trying to come up with compromises to the blood-born pathogens law.

                                              He will not stop coming after those in the adult industry that shoot without condoms. This is not what could happen or what I think the future holds, this is a promise that he has made numerous times in the national media.

                                              I wish you the best of luck shooting down in sunny Florida and sincerely hope that you are never the subject of an investigation.

                                                Porno Dan seems to be predicting that Weinstein will win and that all producers nationwide will be forced to use condoms. He could be right but I'm pretty skeptical of this.

                                                Porno Dan is far more informed than me on these issues and I don't shoot boy/girl so no dog in this fight... but I'm not so convinced this nation will start shooting condom porn just because some guys in LA want to make that the norm.

                                                I don't blame Dan for raising the alarm and putting the fear of arrest into people - if I were shooting condom porn I wouldn't want my competition shooting raw dog either.

                                                      What is certain is that Cal-OSHA is about to submit (or already have) new regs that are adult industry specific to Fed-OSHA for approval (as is necessary). If Fed-OSHA approves those adult industry specific regs for Cal-OSHA they are in essence approved for all of the US. Any state that chooses to -- can incorporate those regs into their OSHA laws.

                                                      Meaning that if Nevada and Florida or any other state does, they can very easily do what Cal-OSHA is doing in regards to regulating porn and condoms. There will be no need for a vote by the public or an Assembly/Senate Bill. A few members of each state's OSHA Board will just need to vote on and accept the new regs. If they do then condoms can become mandatory in any state. Weinstein wont need to push anyone. It will become the new way to get rid of porn from a state that necessary want it.

                                                      Here in Cali, Simi Valley and Ventura County passed similar laws to Measure B once that passed the voters. Not because they had a ton of shoots happening in their town - because they wanted to send a message to the industry to stay away. Weinstein didnt have to pressure them to do it.

                                                      And BTW the regs dont just apply to B/G - G/G will need dental dams.

And if thats not bad enough one female talent refused to work with any US based male talent because of the recent HIV situation in LA.

                                                                      People often say things are illegal when in fact there is no specific statute making them illegal. The vague nature of the obscenity law and the philosophy that a judge "knows it when he sees it" could mean that even some vanilla porn movie could be obscene.

                                                                      Also I think it's important to point out that one can often ask the same question about a certain law or specific scenario to the top five well known industry attorneys and get five completely different answers.

                                                                                No its not false. The law that regulates condoms/barrier protection in California is California Code of Regulations sec 5193

                                                                                This law is called Blood Borne Pathogens (and yes it has been approved by FedOSHA already). Most states in the US have adopted a similar law. So in essence there is a national condom law. The difference between California and other states is that CalOSHA has determined that it applies to porn production when it is really written for the healthcare industry.

                                                                                Other states have not yet taken that position. Could they - yes. Will they - I dont think so since no one has yet. But they could and they could do it tomorrow without notice.

                                                                                However once the NEW regs specific to adult production are submitted and approved by FedOSHA then I think it will make more sense for states to adopt those regs and be able to enforce them.

                                                                                Right now, even with CalOSHA it is putting a round peg into a square hole by using 5193 as the basis for their enforcement mechanism. When the new regs talk about condoms, testing, vaginal and anal penetration they will make sense. The industry will be "vertically integrated" into the regs.

                                                                                However no one that I am aware of has challenged California Code of Regs 5193 in the California courts. Every producer that has been fined for not using condoms has simply paid the fine since it would be less to pay the fine then to litigate the Constitutionality of the regs.

                                                                                But Dan is correct.

                                                                                            They aren't the only company shooting in Vegas. It is also my understanding that you don't need a permit to shoot in Vegas if you are shooting on private property. I can't say 100% that this is true, but it is what I always hear around town.

                                                                                              Another porn company has set up shop in Vegas, and this one comes with Generation Y porn icons James Deen and his girlfriend Stoya.

                                                                                              Deen costarred in ?The Canyons? with Lindsay Lohan and has nice things to say about her. He was in ?Farrah Superstar: Backdoor Teen Mom? and has less-nice things to say about her.

                                                                                              Stoya writes for Vice and sometimes chats on camera with Huffington Post hosts.

                                                                                              Stoya and Deen are not just accepted in the mainstream, but celebrated.

                                                                                              ?It?s partially a generational thing,? Stoya says. ?Because of the Internet, combined with the more graphic sexualization of mass culture, people that are say 20 to 30 are just like, ?OK, sex, whatever. I do this and I do that, and sometimes I have sex with people on camera.??

                                                                                              This spring, Deen and Stoya started coming to Vegas to work in a new WoodRocket.com space ? a 10,000-square-foot Mission Control Studio on Industrial Road. It?s a legal, permitted motion picture studio.

                                                                                              Co-owner Lee Roy Myers, who moved to Vegas with his wife in May, gives you a tour and reveals a big black throne designed as if it?s for HBO?s ?Game of Thrones.? Myers (?Simpsons: The XXX Parody,? ?Porks & Recreation?) and his cast made the adult film ?Game of Bones? for release next week.

                                                                                              Myers sits on the throne at my request, and I ask if he?s had backlash from anti-porn people in Vegas.

                                                                                              ?No but,? he says, ?we?re not on the street handing out pamphlets.?

                                                                                              WoodRocket isn?t just making porn. It?s making anything but porn. WoodRocket puts out non-porn podcasts and Web videos.

                                                                                              The Web series ?James Deen Loves Food? got national media when he ordered one of everything at a McDonald?s drive-thru but was refused service.

                                                                                              WoodRocket has other Web series such as ?Topless Girls Reading Books? (episodes are not book-length).

                                                                                              ?We?ve got a lot of porn stars shooting non-sex things out here,? Myers says. ?There?s a comedy in somebody known for being oversexed doing something non-sexual.?

                                                                                              This week, Stoya filmed upcoming episodes for her November Web series by going gun-shooting at Battlefield Vegas.

                                                                                              ?Then we went and played with kittens? on camera, Stoya says.

                                                                                              Filming in Vegas is bountiful. Vegas has less traffic, more entertainment, better restaurants, and filming is cheaper.

                                                                                              ?In L.A., you need a permit to film your kids running around the yard,? Myers jokes.

                                                                                              Vegas doesn?t have a mandatory condom law, unlike L.A.?s unenforced Measure B.

                                                                                              ?They don?t have the budget to send condom inspectors? to porn sets in L.A., Stoya says.

                                                                                              ?Plus, how are you going to tell someone who signed up for a health inspector job that it is now their mission to go look at genitals all day long??

                                                                                              WoodRocket is a new paradigm. It gives away free video content ? porn and Web episodes ? while charging for merchandise and incorporating product placements and selling ads. Myers says WoodRocket is making money month-to-month, though still paying startup costs.

                                                                                              ?You have a whole generation who has been raised on: ?Oh, porn?s free,?? Myers says.

                                                                                              ?What I think is probably the savior of porn is crowd-funding,? Myers says. ?It shows that people still want to donate money to something they appreciate.?

                                                                                              Other porn is shot here by companies such as Bait & Tackle and the goliath Brazzers. And women run solo Web cams out of their homes. WoodRocket still has crews in L.A. But Myers thinks the people of porn will continue to migrate here.

                                                                                              ?I can see it every day.?
