It's not nice to fuck with Texas! "Texas Proposal: JAIL Any Federal Officials Trying to Enforce New Gun Restrictions in the State!" "A Texas lawmaker says he plans to file the Firearms Protection Act, which would make any federal laws that may be passed by Congress or imposed by Presidential order which would ban or restrict ownership of semi-automatic firearms or limit the size of gun magazines illegal in the state, 1200 WOAI news reports. Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state. "If a federal official comes into the state of Texas to enforce the federal executive order, that person is subject to criminal prosecution," Toth told 1200 WOAI's Joe Pags Tuesday. He says his bill would make attempting to enforce a federal gun ban in Texas punishable by a $50,000 fine and up to five years in prison. Toth says he will file his measure after speaking with the state's Republican Attorney General, Greg Abbott, who has already vowed to fight any federal measures which call for restrictions on weapons possession. Toth concedes that he would welcome a legal fight over his proposals. "At some point there needs to be a showdown between the states and the federal government over the Supremacy Clause," he said. The Supremacy Clause is the portion of the Constitution which declares that federal laws and statutes are 'the supreme law of the land.' "It is our responsibility to push back when those laws are infringed by King Obama," Toth said. Texas is the second state to propose a measure to shield the state from the impact of any gun possession restrictions imposed by Congress or by Presidential order. The typical Federal response is to withhold funding. I'm not aware of the budget situation in Wyoming but here in Texas the state legislature already has major budget issues to deal with when the new session convenes.

They will buckle just like they did with the TSA. The Federal Gov will throw their dick around, threaten to cut funding or whatever scares Texas the most, and Texas will get on her knees and swallow the imperial load.

I'm proud that my state has already proposed, and passed state legislation on guns.
Here's some of what it does. -Further restrict assault weapons to define them by a single feature, such as a pistol grip. Current law requires two features. -Make the unsafe storage of assault weapons a misdemeanor. -Mandate a police registry of assault weapons. -Establish a state registry for all private sales, with a background check done through a licensed dealer for a fee, excluding sales to immediate relatives. -Ban the Internet sale of assault weapons. -Require stores that sell ammunition to register with the state, run background checks on buyers of bullets and keep an electronic database of bullet sales. -Restrict ammunition magazines to seven bullets, from the current national standard of 10. Current owners of higher-capacity magazines would have a year to sell them out of state. Someone caught with eight or more bullets in a magazine could face a misdemeanor charge. -Require that stolen guns be reported within 24 hours. Otherwise, the owner would face a possible misdemeanor. -Increase sentences for gun crimes including for taking a gun on school property. -Increase penalties for shooting first responders, called the ?Webster provision.? Two firefighters were killed when shot by a person who set a fire in the western New York town of Webster last month. The crime would be punishable by life in prison without parole. -Limit the state records law to protect handgun owners from being identified publicly. The provision would allow a handgun permit holder a means to maintain privacy under the Freedom of Information law. -Require pistol permit holders or those who will be registered as owners of assault rifles to be recertified at least every five years to make sure they are still legally able to own the guns.

The stats about federal funding are often very twisted by the funding of federal bases and installations there, as well as federal employees and infrastucture. For example, a massive amount of the federal funding in TX goes to Fort Hood, which is the largest US army post in the world. Texas would get along fine without federal funding actually.

I've was always taught to not bite the hand that feeds you and indeed, Texas is a state that takes more federal dollars than it contributes. It is a typical phenomenon of red states yet they are always screaming about smaller government and ignore the fact that blue states help prop them up.
