Justified Shooting with Handgun Results in Death - VERY NEAR MY HOMETOWN

Justifiable reasons to use a handgun to shoot another person occur every single day. This, from my local paper:

Authorities are treating the New Year’s Day fatal shooting of a Shingletown man by his neighbor as a “classic self-defense case.”

Shasta County Detective Logan Stonehouse on Wednesday said a chain of events led Lynn Hamilton, 56, to fire his handgun at Lee Roy Thibault, 42.

“There’s been some back and forth in the last few days,” Stonehouse said.

Thibault had been living in the area for a few months, Stonehouse said.

Earlier on Tuesday, he had threatened to cut off Hamilton’s head, the detective said.

Shasta County Sheriff’s deputies and California Highway Patrol officers were called about 8 p.m. to 33289 Plateau Pines on a report of an assault between the two men.

While deputies were on their way, emergency dispatchers added new information that shots had been fired, Stonehouse said. Officers and deputies found Hamilton at his home bleeding from both of his hands and Thibault dead across the street in the snow, Stonehouse said.

Sheriff’s investigators say the man had been making threats to kill Hamilton and, while running a chainsaw, threatened to cut off Hamilton’s head.

The verbal threats escalated when the man walked over the Hamilton’s driveway with a baseball bat and again threatened to kill him, sheriff’s office said. Thibault began beating Hamilton with the bat, causing major injuries to his hands, sheriff’s office said.

Fearing for his life, Hamilton pulled a handgun out of his pocket and shot Thibault, the sheriff’s office said.

The man died of wounds at the scene.

The sheriff’s office said Hamilton was not arrested. He was questioned and released by sheriff’s deputies. An investigation is ongoing and when completed will be reviewed by the Shasta County District Attorney’s office. An autopsy is scheduled for Friday, investigators said.

Stonehouse said the sheriff’s office has interviewed witnesses, but would not elaborate on who they were or what they saw.

Clearly he should have pulled a cell phone out of his pocket and dialed 911, and waited for the police to arrive while he was being beat with a baseball bat.

Well, without the gun he probably would have been killed. Now he killed the other guy. So one way or the other, still only ONE died.

Yeah well he started end of they year trolling on gfy. Guess spending the holidays ALONE with a bottle of wine and some guns will make you bored, loose faith in the lord all mighty and come back to good ol gfy to get some attention.

under the circumstances of the story, I would say him pulling a gun and shooting the guy was justified and I am just about as anti gun as it gets.

Having said that, this never had to go that far, this dispute had been going on for days, with the dude constantly threatening to kill him, how hard would it have been for the gun owner, or any of the many witnesses in the neighborhood to pull out their cell phone and video tape one of the guys tirades and send it to the police? Last i checked, it wasn't ok to be constantly telling your neighbors you are going to cut their heads off.

on a completely different note, I wonder what they did to piss each other off so much? the guy who got shot had only lived there a couple months, that's a pretty quick escalation of a neighborly quarrel.

That would indeed be sad. Fortunately for me, projecting your personal situation onto me doesn't make it true. The reasons I've been here lately are pretty easy to comprehend: I check back from time to time and am always up for an interesting discussion. Most of the time there are none here, but lately there have been. Guns, religion and a bit of politics are all things that interest me. The political discussions here, however, weren't very interesting near the election time so I didn't get much involved. The gun discussions, however, have been fun.

Also, I do like a good insult. Sometimes you come up with some good ones. That's fun, too.

Sounds like he was outside on his own property minding his own business. If you have to hide in fear in your own home from a psycho neighbor -- that neighbor got what he had coming.

I don't care what their dispute was it's not that hard to kill someone with a baseball bat. One less dirtball -- too fucking bad.
