    2257 & DMCA Notice Question

    Hi,

    I am in the process of opening a porn site that only deals in affilaite content, no user uploaded content at all. Am going to have a 2257 statement on the site but my question is do i need to have a DMCA notice on the site as well for copyright infringment? I can't imagine it ever being a problem as being an affiliate gives me permission to promote the content but i can never be too sure in this industry?

      Are you actively promoting the programs who supplied the affiliate content ? By actively promoting I mean banners, links, etc, not some hidden link on a busy page.

      If you're not actively promoting then a DMCA link is a good idea, however not putting the content there in the first place is a better idea.

      You might also want to familiarize yourself with what does and does not provide safe harbor, consult a lawyer.
