Once you send them a DMCA which you must first to do exhaust the legal remedies as outlined in copyright laws, all they do is remove the content in question so there can be no further legal action to take.
As long as they comply with your DMCA request, you cant touch them and they know this.

I don't hate Fabian. Personality wise he seems like a decent guy though at times he seems a little lax in the honesty department. It's his company or more likely the company he works for which I have severe issues with. I understand that he's probably following orders and working within the constraints given to him.
In fact I could easily forgive Manwin if they went fully legitimate and made a few heartfelt apologies with some restitution while also helping to join the fight against piracy within the industry.

Yes. It would be much the same thing if the shoplifting laws were changed such that once caught all the thief has to do is once found guilty give back the stolen items (in whatever condition) in order to avoid conviction. The thief still would have free use of the items until the trial and is free to continually shoplift over and over as much as they like as long as they ultimately give back the items. The burden of proof would always be on you to show that the shoplifter actually intended to shoplift as opposed to just "accidentally" forgetting to pay for the items.
If this were the way it worked you could probably imagine how bad things would be for retail stores.
