If you acquire an email list legally and each person on the list has explicitely agreed to accept advertising sent to the address then that's absolutely FINE. That's called email marketing by the way. It's perfectly legal and legitimate although many people, from ignorance, complain that it's "spam" when in FACT it's not if they signed up for it.

"spamming is advertising" is like saying "theft is earning".

How would you define a program that owns a board (not here) that allows hundreds if not thousands of links to pirated porn on filelockers like bitshare and depositfiles?

If I personally owned a board and people were posting links like that, and then the company who owned the content informed me about it, I'd certainly be open to blocking the urls or directing them to the appropriate paysite perhaps.
That's all I can really say I guess since as far as I know it's hypothetical (but I get the feeling it's not).
