somebody had it right in saying that this kind of case shouldn't be decided by jury - can't expect the general public to have the ability to decide this type of case.
yes, Samsung copied the Iphone - but it's a fucking cellphone, OMFG the Galaxy has rounded corners and icons with rounded corners, for the rest of time Apple is the only cellphone that can have rounded corners! I haven't followed the case at all so maybe there's a lot more to it but there should never be a patent on anything like that - who was the first cereal company to put cereal in a square box with an illustration on the front? They need to sue all the other cereal manufacturers, they were first to have a square cornered cardboard box with an illustration on the front. patent laws are ridiculous. |

The thing that made Apple cool originally was its' ease of use vs. PC (Microsoft) computers. Click click click click on a PC to do what Apple did with one or two clicks. Plus, Apple seemed/seems more "intuitive" as an operating system, it's easier to learn for a newbie, etc etc.
THEN Apple decided to go to war via design and sleekness vs. market share. What else could they do? They already had what many considered the superior operating system (which they sued Microsoft over let's not forget, a suit that almost broke up Microsoft like Ma Bell was) but because PCs had dominance in the business community Apple had no other way to stay afloat. Artists and musicians preferring Macs would not save the day. So Apple went for sleek designs and were crawling back to competitiveness when the music industry, as a whole, sucked its' own cock and choked on its' own cum..... HUH? Yes. Remember Napster? After the RIAA successfully shut down Napster there was an 18 month window where there were (virtually) no file sharers or MP3's being uploaded every dman place like we have today. I was at the tail end of a fifteen year career in the music biz at that time so I know firsthand what happened. I (and a few others) suggested the major record companies IMMEDIATELY create online 'record stores' where they could sell their songs and albums via download. Hey, sounds like iTunes, doesn't it? Record Industry: "We don't want to de-value our product or encourage copying via the digital format. plus, online stores would hurt CD sales." Then along came iTunes, the iPod and the rest yada yada... 'Twas the iPod that made Apple what it is today. |
I read more about the case and thinking about it, Apple deserves the money, but that's the end of the story. They shouldn't be allowed to exclusively 'own' the UI crap they were given patents to.
Here's what a judge or jury should have to ask themselves in cases like this - is it reasonable to assume that whatever is patented would have been developed by somebody else in a reasonable amount of time - pick how long that time frame is. Patents should be given out to only truly unique innovations that are far ahead of their time, where it's not reasonable to believe that the innovation would have been developed by anybody else other than the patent applicant. |

IMHO Samsung has just slam dunked themselves into being the "competitor" to apple
if they can wriggle out of the copycat thing and make themselves look like the aggreived party they have just pawnd HTC. Nokia, rim et al. for less than a billion. Every single product release they do from here on in will be plastered all over the press as a response to apple and analysed in depth. massive PR. It's like the Virgin vs BA PR stunt or the ben and jerry ice cream. classic minnow vs whale (except they aint no minnow) You can bet there are now millions of punters who now see Samsung phones as direct alternatives to the apple phone, but cheaper and so now cooler. Nokia, RIM and HTC are now relegated to the third division with windows working out how to get in between the two. Samsung has a revenue of 150 Billion, so providing they can control the backfire they could win. Their PR is in full overdrive making look like the bully apple is stopping them make rectangular phones with rounded corners and they have reached more users now because of this and their upcoming appeal than they could have hoped for. |
samsung is unbreakable since the beginning. Apple is expensive, breakable, cannot simply change the battery, and it's being used by hipsters whom i despise. Samsung wins.
