Criminal copyright infringement and contributory infringement obviously do not fall under "freedom of speech" or "freedom" or "a free society". The current case is botched, because of the procedural violations.

They may be able to make an arguement against him in the future, but before they go forward they will have to prove that it is not just another botched case .

1. copyright takes away property rights and replaces them with licencing rights.

2. vcr, printing press, cable television, mp3 players, etc, etc, were all called copyright infringement and were ultimately validated as perfectly legal

3. many countries don't have contributory infringement.

I think arguments like that are usually the last refuge of selfish, self serving assholes. Not everytime. But most of the time.
