It doesn't matter if you've paid unless there is a work for hire agreement assigning the copyright and there isn't.

The ownership of the content remains strictly with the website and / or the performer who recorded the content, depending on the agreement the site has with the model.

A customer can usually record the live chat for personal use. Even if its not allowed, its impossible to stop because there are so many ways to do it. It is still "illegal" under the terms of use of the website. Just because the customer is paying for the live chat does not necessarily mean he is allowed to record it, but as I said its impossible to stop.

Re distribution of the recorded content though is usually NOT against the agreement some sites have with their models. Buried in the terms of service that models have with some sites, the sites say they are allowed to re use or re distribute that recorded content for any reason they like. There was a big fight on another board a few months ago from a chat model who's content was given away to affiliates.

It is also a complicated issue. The content as I said earlier can be owned by both the website and the chat model. In this case, the owner AND the chat model deserve royalties from the use of that content.

If all you want is this kind of content, there is a much easier way to get it. Why not just invite a couple of girls over and have them sit on a bed and wave? You could record it with any webcam to get that "webcam feel", have the models sign a simple model release and pay them for their time?

This way you will get exactly what you want, in the exact quality you want, and you will own the content legally.

You are gonna have a big problem with some sites, studios, cam girls if you go down that road.
