If not, then he will settle for a huge amount or lose his domain. Either way, he is about to lose.

Looks like CCbill may be getting drug into this after all.

Either way, Oron as we know it is about to be over. :thumbsup

Neh, been said many times before - he lives in Germany. Usual "director" crap with mailbox address.

Either way it seems like a real breach of privacy for a 3rd party to disclose IP's. Especially shady making that disclosure to a company who's sole purpose is to commit crime.

I've been told that by a few people now. I didn't really stress over it, Oron has blocked a lot of my IPs in the past after sending them shit loads of DMCAs. I just chalked it up to just another shitty day in the business.

However, the GFY/AVN - Uploading.com connection made me think about it for a bit at first. Figured file locker guys talk to each other just as we do. But Theo claims the owner is just a guy from a corporation formation service who was used by both companies, so who knows? But I do know when people are trying to hide who they are and use services like that, it's usually for a reason.

I just answered this, put an image hosted on your server in your sig or in a post, check your logs it will have the IP address of every poster. no need for exploits.

I have no reasons to doubt that what you say is true. Like I said, I think you often bring valid points to the table. :)

I'm just glad to think that people who have profited over stolen stuff are going to lose those profits.

How to pinpoint my USA VPN IP out of how ever many IPs they may have collected?

Ditto.

I don't care about the he said she said nonsense. But I'm damn happy this guy is going to either lose a lot of money or lose his site. Either way, he loses. That makes me happy.

You're right. Had to think about that for a minute. :) I bet they put a block on a few people trying to pinpoint DWB.

My IP is banned, yours and I remember Konrad's was too, my guess is they banned IPs with the most hits and those they could cross reference by country.

this does not make sense...

DMCA protects oron and all the other sites.

DMCA protects internet providers - gateways. DMCA protects a company like Comcast from the actions of it's users. It does not protect sites that operate as piracy hubs. These are willful infringers who pay for and charge for the dissemination of copyrighted works.

It also does not protect end users who are also willful infringers.

If Oron is compliant with the DMCA, that might well be true; the heart of Liberty Media's complaint, however, is the assertion that Oron simply does not comply with DMCA, and that it clearly did not comply with an important provision of the statute prior to July 2011.

From the complaint:

Quote:

Normally, a web hosting company takes advantage of the ?safe harbor? provisions of the DMCA 17 U.S.C. § 512, and would not become a defendant in this cause of action. During the period of most of the complained of infringements, Oron did not have a registered DMCA agent. It is not entitled to the DMCA?s safe harbor provisions for the complained of infringements.
There is much more to complying with DMCA than simply honoring take down requests. As the bit from Liberty's complaint that I quoted above suggests, one of the other important facets of compliance is registering a designated DMCA agent with U.S. Copyright Office, and subsequently publishing contact information for that agent on your website(s).

Oron only registered its DMCA agent in July of last year, so with respect to any infringing activity at issue in Liberty's complaint that took place prior to that date of registration, the court may well find that Oron should not benefit from DMCA safe harbor with respect to such infringement.

Beyond that, there's nothing in the DMCA that protects you from contributory copyright infringement claims if you are willfully and knowingly profiting from infringement, even if the direct infringement itself is being perpetrated by third parties.

Which brings us to the following claims in Liberty's complaint:

Quote:

41. Defendant Oron.com induces its members to upload content in the hopes that it will be downloaded in massive quantities, such as full-length motion pictures belonging to Plaintiff Liberty.

42. Oron rewards members who steal copyrighted content and provide this content to Defendant Oron.com. Defendant Oron.com publishes illicitly obtained copyrighted materials to lure potential members to its website.

43. Defendant Oron.com engages in this illicit activity for profit. The members uploading the illicitly obtained material also profit.

44. Defendant Oron.com compensates members for their infringing activity.
If Liberty can provide evidence of those claims at trial, in combination with the lack of a registered agent for Oron prior to July of 2011, I'd say Liberty is in a pretty good position to come out on top in this case.

You check the time of the hit against the time of a post, throw in the referer string and it becomes pretty easy.

And again CF takes the lead. Good news!

A couple of gay companies (CF, Titan, C1R, Blu Media, Porn Guardian) have been extremely succesful closing illegal tubes, file lockers and forums. Even when it comes to a settlement, Oron will be hit hard. Others will follow and they can't settle forever.

If they are an advertiser who hosts his own banner images. Then they can see the IPS hitting it

Am I right in thinking that they are banning IPs that submit many DMCA requests?

MrDeiz 06-21-2012 02:02 PM

what's Liberty Media / CorbinFisher history on all those lawsuits.
i see it all the time on the news, but don't remind any report on the outcome

JimmyStephans 06-21-2012 02:03 PM

In a previous Liberty / CF case, versus Hotfile, it eventually came out that Hotfile had direct communications with posters - giving them advice on boards to post to, popular files, and things along those lines. That would take away any DMCA protections because the host / site is no longer just a host.

These guys are running Forumophielia, RedBitch, PornBB and others. I think that might play into the case when the time comes.

Its up to the lawyers now.

Almost all of them are settled with Liberty getting good payments. There is a site called RFCExpress where you can look them all up, get the latest documents, etc.

Use Tor when posting here. It'll stop that shit cold. It's better for your security too.
https://www.torproject.org/

But I suspect they are also getting the IP from the person who submits the DMCA takedown. Take countermeasures there too.

Colorado Secretary of State records show additional addresses (updates) since the time he created the LLC - which I think one of is the Denver suburb of Golden and how Liberty got that in the suit.

The company you work for reached a settlement when it sued Pornhub. Why didn't Pink Visual go for a winning decision by judge or jury and reap the damage awards?
