update A domain name registrar in Germany has deleted the registration for a gruesome U.S.-based online photo gallery that featured stomach-wrenching images from autopsies and medical procedures.

Computer Service Langenbach, which operates the Joker.com registrar in Dusseldorf, Germany, yanked the Ogrish.com domain name from its database this week in response to a request from a German prosecutor, said the hosting service and the owner of the site Tuesday.

"I've never heard of a case where a registrar can disable a domain over content," said Ted Hickman, who runs Virginia-based ProHosters.com. "I certainly won't be registering any domains at Joker.com...We'll host anything that's legal in the U.S. It's not our job to determine whether content is acceptable to others."

Neither Computer Service Langenbach nor the German embassy in Washington responded to inquiries. A search on the domain Ogrish.com in the Whois database lists it as "disabled by government."

If you run a website, you should be concerned about this type of bullshit. Some random German prosecutor asks for the site to be shut down and they do it? Not only that, they may delete the domain. Imagine if any prosecutor in the country where your domain is registered could get your site shut down just because they don't like it.

I support Ogrish and have for a long time. Given that Mick Mercer, whom I'm fairly certain has written more books on Gothic culture than anyone else, called me the 'King of Goth', I feel fairly qualified to speak on behalf of the whole class. Many many of us dig Ogrish.com, or at the very least, hate to see things banned for objectionable yet not illegal content.

Pardon me if I don't always care. I don't like censorship, even of things I don't like. On the other hand, I refuse to get up in arms every time something happens to someone in some country. The world is full of injustice. Usually, I react to it. Sometimes, I have to take a day off from caring about the little stuff.

Isn't Germany also the country that deems it illegal to display any adult material if it is not behind some sort of AVS?

I've heard of people getting letters from some organization over there, asking them to take down their site or to put it behind avs, or else if they enter Germany they will be arrested.

Let me elaborate a little. Censorship sucks. However, what do people expect when their domain is controlled by a country with censorship laws? Their first-ammendment argument is totally invalid, since they were dealing with a non-US provider. The first amendment does not protect Americans from the laws of other countries if they are in, or do business with, those countries.

If you use a German registrar you agree that the contract is governed by German law and in this case Joker.com complied with the judgement... why would they fight?

The German law is fucked up when it comes to the Internet... in many cases the reason for strange decisions is that the judges don't have a clue and many judgements are appealed successfully.

This is really scary stuff that should have us all scared. It is one thing if we use the right to charge with a visa card and quite another if they just sieze our domains. At least you could find another way to process cards and/or money.
