I used a public defender once, they are not all hacks. Many states require their attorneys to volunteer time in court, and you can get a decent one. Of course, one time I was going to use one and decided to rep myself instead. Definitely the smart way to go at that time.

If this is your first offense, does your state offer a wet reckless to plead down to?

We don't have any of that, apparently. No hardship thing on the DL, either, AND I had a first offense in 2007 .... We don't even have the "both tests within x%" thing, to my knowledge

Guess I have to feel out this PD and see how comfortable I am letting him hold my life in his hands ... heh

The worst part is that I don't think I'm even guilty. I passed the field tests. Now I'm reading that having acid reflux can add to the number, having a cell phone or being close to a tower can interfere, etc. . . Plus! The stupid machine assumes everyone has the same partition ratio and it makes its number out of a 2100x multiplication of what it measures and it measures all KINDS of different things as alcohol PLUS if you have any mouth alcohol it'll raise your number through the damned sky hell I just saw this guy on youtube, completely sober, he ate wonderbread and blew a .07

Can two drinks over the course of spending 5 hours somewhere really cause a .013? I'm not believing it ... They SHOULD have to prove I am guilty. I am going to have more evidence than THEY will, at this rate.

The implied consent thing always bothered me, as well. It is very clear that in DUI cases the constitution doesn't seem to apply. It's more of a prove you're innocent than prove I'm guilty type of thing. Plus, implied consent when you're a licensed driver means you agreed to all sorts of shit you never knew about.

See, I have a hard time believing this.

I am someone that truly does not drink and drive. I won't even have one drink if I'm driving because it's never just one drink.

I'm up for 0 DUI offenses and unless how I do things changes, I never will be.

Granted, I wasn't always a saint when it comes to drinking and driving. I used to drink and drive but I wised up about 7 years ago.

Did they take a blood sample?

If no, then fighting it may be worth it - BUT you'll need an experienced, dedicated (as in not public defender) attorney to argue the breathalyzer machine's results aren't accurate - ie. not calibrated, not operated correctly, faulty design, etc.

Most rights people presume they have are a legal fiction. Much of what one was taught in school is wrong / lies - the comedian George Carlin was spot on. Not the fault of teachers per se - they often mean well, but too have been hoodwinked into believe the system is for the average, working person - not so at all, but I digress.

As for using a public defender - it's not necessarily "free" - there can be income requirements for getting a public defender / avoid getting billed ... likely not an issue unless your income is well into the high-5 figure or more range, but something to keep in mind.

They didn't take blood.. as I understand it some of the high dollar lawyers will even try to fight THAT .. improper storage, contamination, blood fragmentation or fermentation or some shit, etc etc etc ..... sounds like they're really grasping at straws trying to beat a blood test!!!
