what legal action can be taken against a tube that is ignoring DMCA emails. i cc'd their host on the last email to hopefully get some results. it's bad enough that these douchebags are ripping my entire member's area to pad their tube but now they are adding their watermark to them.

You should have talked to Paul - He would have advised you NOT to give affiliates access to your members area... In other words, Paul says its all your own fault!

Personally, I feel sorry for you, but as an industry professional, I need to remove my hat to Paul, and state that had you listened to the master, you would not have this problem...

A quick look shows they host in the USA. If both the host and the site is ignoring the DMCA, sue them both. You will win. At least with the host you can find and serve them, and they have assets. The site owners... who knows.

Document EVERYTHING and make sure you're sending a proper DMCA notice.

Have you tried making a complaint to their registrar? You may be able to get them to release the contact details for that domain.

Yep. DMCA is really designed for hosts. If they comply with the DMCA, they are in the clear. If not, they are liable.

Dgraves, do you have good password protection and a downloader limit? Password traders and hacker, fuckers were bad for getting in, ripping sites on an auto downloader and then giving it away.

i currently use proxypass and it works well. i just recently increased the username and password requirement from 6 characters to 8-12 which seemed to help.

We do have protection in place. We use Strong Box and throttle box. Excellent products by the way.

The key is the hosting company. If you contact their hosting company, they will take action. Any US host will take action, soon or late.

The problem is if they are hosted in a place like thepiratebay server, can't remember the name of that hsot now. They will ignore everything and there is nothing someone can do.

i know most of these fuck sticks are on the ropes because they have so much pop-up/under crap on their sites that it's a clear act of desperation. they don't want people to select a product, they're going to shove it down their throat.
