You think they've kept track of affiliate referrals and rev shares since they closed shop, will continue the recurring subs now that they posted a thread about paying back?

If I go into a store a take a tv, but give it back in 3 months, do you think the cops will say, "it's cool bro, you brought it back." If I rip your site and post all the videos online for 3 months, will you be cool if I come back and say sorry afterwards?

As long as I have been in biz I have had plenty of no-pays, late-pays, delays, way-laids, and checks in the mail promises... If someone tells me they intend to pay then I give them the benefit of the doubt first. So your analogy is not even accurate or informative; it is just sophistry to try and make your point but it is baseless and misleading. If they say they will pay then what is the harm in giving them the benefit of the doubt?

Give you an example, just so you understand that without having all the facts, you shouldn't accuse them of stealing based on assumptions.

We once had a vendor that was half our total income literally close shop overnight, take all the money, the lists, data, etc. and move to a desert island. Now that was an event that we had zero control over which instantly cash strapped us, but the worse problem was that part of what we should have been paid was also owed to other producers like Dave Cummings.

Now we knew we would never recover a dime, but Dave still expected to be paid. Due to the circumstances we delayed payment, Dave was not happy, but we eventually rebounded and paid him. Were we stealing from him? Never. Was he paid. Yes. Did it take a while to make good and was it a messy pain in the ass to deal with? Yes and yes. Did Dave think we were stealing from him? Probably. Did he realize in the end that we were not. YES.

Don't assume anything. And if someone says sorry and I will pay then what should be asking is "when and how" not saying pretty much only "fuck you". What good is that going to do?

And yes, I do believe it is possible to accurately pay back every penny with a proper audit of their transactions.

But there is a big question to be asked here. If her income has dropped so much that she cant pay her mortgage for 4 months (meaning that her mortgage company has most likely started foreclosure proceedings unless she has a loan modification) then how will she make payments to affiliates?

Sounds like there is no more traffic, rebills are dying, and the money well has dried up. How do you pay people with no money? Apologies dont pay bills, especially with how (rudely) she just shut off everything and now its like, oopsie my bad.

They just shut down the program without warning and said that's it, no more payments, no more rebills, that's it. I don't know how much clearer a case of theft can be. This is no different from epass leaving stranded money in your account and closing, no different.

First of all, making an announcement that they were closed and there would be no more payments is way more ballsy and honest than any of the scumbags that have ripped me off ever were. As a creditor I know from experience that it is much easier to make the right decision when you know you are fucked than if you are being strung along with false hope.

Also coming back around and stating an intent to pay everyone back is a move you don't often get from thieves.
