Blog Hosting question and 2257 law

Hi,

I want to start a blog with amateur pictures. If Im uploading the pictures by myself, do I need 2257 documents? Can I host it in the USA?

If you look at tumblr for example, there are also a lot of amateur images but nothing with 2257.

Thx and sry for my bad english

You need 2257 documents always. Even if you live in an unknown third world country. The united states expects you to follow their laws if you intend to serve content to their citizens. The only way not to have to use 2257 is if you completely blocked US traffic from your site, which it would then generally be pointless to even bother launching a site. Unless you are planning a non-english website.

Hi,
thank you for your answer ;)

My site will be in english so I cant block us-traffic. But there are also a lot of sites in english without 2257 documents.

e.g. whatboyswant.com

What country are you located? Where will you be uploading the pictures from? If you are outside the USA you don't need 2257 at all.

So you're going to make a site with content you don't own. Nice, another thief.

There are some good content licensed deals out there. I licensed nrearly 20GB of asian content for $100. Stuff from the late 90's to early 00's. Just go with that.

Then you don't need to worry about 2257. Look at the laws in Germany.

Any image you serve should have government issued age documentation (in its line of succession) in verification of that person being at least 18-years-of-age.

"in its line of succession" means the producer (maker) of the image -- in other words, from where you have gotten the sexually explicit images. You would need this to raise an "affirmative defense" to issuing any underage explicit images.

If "Suzy" uploads her naked pictures to your server -- you better have ID documentation from Suzy to prove she is of legal age.

(Not given as legal advice for compliance with U.S.C. 18 §2257)

If you aren't America, go for it. Just make sure the pics are legal.

People giving advice about you being outside the US and not having to follow 2257 are morons. Good luck, you will probably listen to the advice that you want to hear, meaning not me. Hopefully you will not learn the hard way like I did ( I am not
American ). That's all I have to say here.

If someone complains to your domain register or host they might cause you some problems.

With so many sponsors to choose from I am sure you can find some good content.

I already did, here it is in more detail.. For some reason people think porn is some how elite and does not really need to comply with all laws. It's like any business, if I open a shop in a local community I will need to follow their local laws. Thy also applies to WHERE you are promoting your business. If I open a flower business in Germany where roses are legal, and I start promoting my products including roses in Saudi Arabia where roses are illegal ( not true, example only ). How would that be fair for me to sell illegal flowers in Saudi Arabia compared to the other local flower shops located in Saudi Arabia that are following the law?

This is no different than the Internet, if you want American traffic and America customers then you have to follow ameican laws otherwise you are concidered harmful to American citizens on a federal and state level. Sorry if I did not explain this very well, I am typing this on my phone while making dinner.

You could face quite some other troubles than 2257 compliance if based in Germany and not following local regulations.

Only allowing those 18+ entry for example. And no, "click to enter if you are 18" does not count.

the best piece of advice anyone can give to you is this: Don't ask questions like this on a forum of any kind and instead contact a local attorney that specializes in internet law and is very familiar with your local laws

Well, it depends on what country they are in re: the laws but if the subject domain is a .com, .net, .org or .us the US AG DOJ can pull the plug (ICE-- domain forfeitures).

Also, where the server is may allow this -- it is called an in rem forfeiture.
in rem Of actions for recovering or reducing to possession or enjoyment a specific object {action against property not persons, e.g.; confiscation of a server}

Best to have the age ID documents ...
