For the reasons I listed on page one. Our justice system is based on that law in that the government should not prosecute a case until they are sure that they have all the evidence needed to secure a conviction.

Otherwise prosecutors would keep dragging anyone who was found innocent of a crime into court until they got any sort of conviction to stick. As with anything ruled on by the supreme court, there are no exceptions.

Unless there is a statue of limitations...and I don't think there is...he could be tried for a violation of their "civil rights". The Feds have used this charge many times when jurors have aquitted murderers and for lesser crimes also. The Feds charged the cops that beat Rodney King with a violation of his "civil rights" when the state jury aquitted them and they went to prison after being found guilty of the Federal charge. I am not certain but I think the max on the charge is five years.

Who did he conspire with, himself? A conspiracy has to involved at least 2 people. That would also mean proving premeditation. If he was just going over to see Nicole and he saw her with Goldman and went apeshit and killed them in a rage that's not "conspiracy" since it wasn't planned.

If he came out and confessed they could always find something. They wouldn't put him in jail for life and he'd never get a sentence anywhere near as harsh as murder 1.

It's tough to say what he would be charged on as different charges have different time limitations. For instance, time has probably run out on any domestic violence charges. The violation of civil rights is one I have heard of before. Also if they can show any of the wounds were inflicted post mortem he could get abuse of a corpse, etc.

Here's a case where a guy killed his fiance, was acquitted, and then when further evidence came out he confessed. They wound up putting him away for perjury a few times- http://en.wikipedia.org/wiki/Mel_Ignatow
