      DMCA is made to take content down. I think private is fine with their content being displayed, but they want to get compensated since it is used commercially.

      Just because a site takes down content, does not mean this frees them from paying for previous use.

          You've obviously never been a party in a lawsuit. This is how it's done. I'm always amazed how little people understand of the US litigation system.

          They list defendants as Doe's and make a request to the court for discovery, and then can subpoena ISPs, banks, merchant gateways, registrars, anyone and everyone connected to the site. The Doe's leave open the option to add third-parties as contributory infringers, and these third-parties know it. The pressure becomes enormous, and the defendant ends up writing a check. These cases seldom go to trial, which is what trial lawyers want.

          It doesn't matter where the owner is, or whether he or his designated agent appears in US court, because it'll never get that far.

            I've always been a big fan of Private/Private Cash and looked forward to promoting their sites. However, upon further research it was apparent that their content was widely available on the tubes. When and if they prevail in getting their content removed from the tubes I’ll definitely be promoting Private Cash sites again.

            Until then, I wait with great anticipation and the hope that others in the same position will follow Private's example and actively protect their assets.
