From what I read he was only in NYC for the one night and that was because he was visiting with his daughter for lunch (or something like that). Since he wasn't there on 'official' business he can't use the diplomatic immunity card.

It could be that he repeatedly does this but he's usually covered by diplomatic immunity. If that were so, he might have just grown accustomed to being able to do what he wants when he wants, and he forgot that he wasn't covered this time.

It could also very easily be a frame (maids are not above being bribed I'm sure), and considering he's knee-deep in the political scene, anything is possible.
