A group of lawmakers and conservative activists says the administration needs to start paying more attention to adult pornography. In a little-noticed move, Attorney General Eric Holder closed down the Obscenity Prosecution Task Force, a unit set up during the Bush administration to combat obscenity. It was set up due to pressure from conservatives about the proliferation of pornographic images on the Internet and never really had much success, but critics insist the move is a perfect example of how the White House has turned a blind eye to the issue. The Justice Department insists it is not giving up, but concedes that its priority involves child pornography since the multibillion dollar industry is now ubiquitous. Although the law against obscene material that violates community standards is still in full effect, it's much more difficult to find a jury these days that would be shocked by pornographic images that don't involve children. Under pressure from conservatives, the Bush administration created the task force to ensure that at least some obscenity cases not involving children were pursued. But even as it aggressively sought cases it mostly ended up pursuing small industry players, reports Politico. Lawyers for the adult industry praised the move to shut down the task force. "It just seems like, finally, the Department of Justice has caught up with the rest of the nation," one lawyer said.

Even the dems who are gay, are mostly openly gay and I can't say I've ever heard of a dem getting caught in that kind of situation in the media.

Regardless, I think this administration closing this ridiculous 'task force' shows pretty well the difference in overall attitude towards porn. Do american's really want their money spent on this?

In 1998, Holder pushed porn cases

One historical note regarding my story this weekend on Attorney General Eric Holder's disbanding of a Bush-era Justice Department task force aimed at prosecuting hard-core adult pornography: back in 1998, Holder actually encouraged U.S. Attorneys to bring such cases.

At the time, Holder was the No. 2 to Attorney General Janet Reno. He penned a memo on the subject that, for some reason (transparency kudos!), is still posted on the Justice Department website:

[P]riority should be given to cases involving large-scale distributors who realize substantial income from multistate operations and cases in which there is evidence of organized crime involvement. However, prosecution of cases involving relatively small distributors can have a deterrent effect and would dispel any notion that obscenity distributors are insulated from prosecution if their operations fail to exceed a predetermined size or if they fragment their business into small-scale operations. Therefore, prosecution of such distributors also may be appropriate on a case-by-case basis.

Holder's 1998 memo was cited by senators in a letter they sent him this month pressing for more adult obscenity prosecutions.

It's difficult to say whether the task force was following Holder's 1998 advice or not. It did bring some cases against large distributors, such as Joe Francis of Girls Gone Wild and John Stagliano. (Francis pled guilty to failing to maintain age records and tax evasion. Stagliano was acquitted by a judge) But a couple of the most recent cases the task force brought, against Barry Goldman of New Jersey and Ira Isaacs of Los Angeles, targeted solo operators working at the extreme fringe of the business. (Goldman pled to an obscenity charge and got six months home confinement. Isaacs is awaiting trial.)"

If indeed General Holder and The Obamination are actually going to slow down or discontinue porn prosecutions, why is this memo still posted to the Attorney General's website?:

As a result of this unprecedented growth, I wish to remind you of the Department's policies and priorities in the prosecution of federal obscenity cases.

There are a number of federal statutes relating to obscenity and child pornography. See 18 U.S.C. Ch. 71, 109(A), 110, & 117. Because there are many state statutes prohibiting obscenity and child pornography, and obscenity in particular is determined by local community standards, federal investigation and prosecution should be undertaken in those areas where there is a need for federal resources. Thus, the Federal role in prosecuting obscenity cases should be to focus upon the major producers and interstate distributors of obscenity and child pornography, while leaving to local jurisdictions the responsibility of dealing with local exhibitions and sales. See USAM § 9-75.320."
