nope fuck 2 weeks. If she is clueless and you can afford it tell them you are done and just leave. That will be the biggest nut punch to them. I was told i was going to loose my job by a DM when i worked for a retail company. Dumb fuck told me i was gone in 2 weeks and it was me the DM and 2 other counter guys. He walked out the office i spun the lock to the safe walk out gave him my keys to the store and got in my car and left. I laughed. As i pulled out the counter was full of people DM could not make change cause he didnt know the safe combo and the delivery truck was pulling in. I had another job the same day for the competitor down the road and got more money. Win win. I was in commercial sales and within 3 months had all my mojor accounts at the new place of buisness.

As for training the replacement - if you can overly complicate it, go for it. Make sure this replacement knows just how time-consuming the task is and what she will need to learn (SEO optimization, Photoshop, Digital photography, HTML, working with an incomplete content manager - does she know how to program, etc. etc. - hopefully the server is running some flavor of linux) and how it will likely impact negatively on her ability to make more income doing what she does best (i.e., selling and giving head to the manager).

While all this is being negotiated, ping the other car dealers in the area (making sure that you stay away from any that are related to yours - e.g. if yours is a part of the Myers group, stay away from the others in the group).

Good luck.

are you in Ottawa? sounds like it :)

PornGreen 02-02-2011 06:45 PM

wait, she made $80k a year and you made more, is that correct? or they want to give her your salary plus her salary to make her happy?

i would not train her.

JD 02-02-2011 06:51 PM

mind shooting me an email with your contact info (aim/icq/msn/etc)? I want to talk to you about this in great detail :)

MetaMan 02-02-2011 06:53 PM

Phone the guy/girls house phone at real late nights, one night screaming at them, then the next night crying on the phone, do this for up to two weeks, then have a one day pause.

Then the day after the pause randomly show up at the dealership with a giant sign smearing them about being a homosexual.

Then when they call the cops on you punch yourself in the eye and tell the cops you were assaulted.

Sue them for a million dollars, retire.

Kiopa_Matt 02-02-2011 06:58 PM

Are you getting laid off or fired? If laid off, and assuming you have the 900+ hours logged, you qualify for EI. They can't just fire you for no reason though, as it's against the law. In order to fire you, they need to prove you were damaging the company, plus generally, give you notices and time to improve.

she wants to make 20k more.. and had the oppertunity elsewhere.. she been at the dealership for 11 years and the #1 sales person.. so I can't blame her.. the manager offered her my job as extra duties assuming she could do it, she would stay and they wouldnt have to pay me 45-50k.

but I am certain she won't be able to handle the extra duties and its only a matter of time before she brushes it off to the side or say fuck that and leave.. I don't see her staying there much longer..

anyways I'm done venting..

laid off I am assuming, which is the real point of this thread.. I just want to make sure I can get EI and buy myself some time to present myself to other dealers

CYF 02-02-2011 07:14 PM

If they want you to train her, I would tell them that your consulting fee is $100 per hour.

Agent 488 02-02-2011 07:15 PM

when's your last day?

make sure to get them to give you a lay off letter take that down to ei and it will be seamless.

You should be building up auto leads to your own car selling websites and selling them to the highest bidder.

You'll have all of Ottawa's car salesmen hassling you and having bidding wars.

Show me one salesmen who doesn't want his phone to ring 80-90 more times this month.

I agree, one thing im thanksful for is the oppertunity and everything I learned working there, I should definatly be working on my own site now as you say.

For the OP, they are abolishing your position.
So, train the person , but make it clear to the manager that the pink slip must mention that position is abolished.

You will get Unemployment benefits and the UI will find you a job .

Play ball with them .... :2 cents:

LiveDose 02-02-2011 07:37 PM

Get her to start spamming the dealership domain all over the place.

MrBottomTooth 02-02-2011 08:53 PM

Here's the employment standards act. If they violated any part of it in any way, you can fuck them over. I would check it out and see if there is any "negotiation" room.

http://www.labour.gov.on.ca/english/es/

In some cases even Union contracts don't meet the entire obligations of the ESA.

ShellyCrash 02-03-2011 12:32 AM

Your knowledge is your leverage.

#1- Negotiate your severance package before you train her. Get everything in writing before you show her anything you do. If they drag their feet if you have any PTO days now is the time to cash them in until they decide how much they want to pay you.

#2- After the 2 weeks has expired, leave yourself open for questions (but not work) for the full period of your severence package, but once that time is up let them know if they want your assistance they will have to pay for it.

v4 media 02-03-2011 01:34 AM

contact every other dealership and tell them you'll work on a leads only rate. if you know you can pull in x amount. the $$ can rack up pretty quick.

lilith_pet 02-03-2011 03:27 AM

That sucks. Especially considering you did nothing wrong. Don't give up, you'll be fine

A top sales person at our dealership said she was going to quit because she wanted to earn more money, she makes 80k and wanted to make more.. so they gave her my job and my pay because they dont want to lose her and I been there only 8 months compared to her 11 years.. my used car manager is thinking about quitting and following me where ever I go..

hmm i'd call Services Canada about that or EI and ask about it. Weird they should give a reason better then that I would think. But I could be way off on it. and as for papers for EI, they haveto give it. And ALWAYS check that they send it to EI to gt ur benefits soon a possible. If not, then it'll be a trip to the Laurier street office (if it's close to you) and hand them a copy.

But yeh sorry to hear about it and I would still call and ask if they are allowed to do it

Yes, teach her. But make everything seem extra difficult. Make her edit the sites in Notepad, for example. Find a way to add extra steps to everything. Talk really fast and use lots of big words. Go through SEO theories and search engine algorithms. Uninstall Dreamweaver and use a command line FTP client. She will realize it's too hard and call the whole thing off.

Canada have cut my web designers application even from outside, so they easily cut you in there for no reason.

pornguy 02-03-2011 07:09 AM

If you have stats on how good your leads were. How many came to the dealer ship and how many of those bought then you might have the beginnings of a private company.

Rebel D 02-03-2011 07:16 AM

One thing to Remember. If you go to sue them or any litigation the Labour board says they will not help. So talk to a lawyer see what he thinks. the Labour board is Pretty slow gettign things done it seems right now but they get to it.

Sorry to hear this man...Saying sorry feels so trite...I know exactly how you feel... Was handling a department when the powers to be wanted me to train some people from the US office so that they could jump in to do my work when Canada was on leave....Guess I taught them too well when I was fired after I trained those people and gave a +report about them a month later.....Though I did get my ROI....

My suggestion....Call the labor board. And you are definitely eligible for EI since you must have worked more than 600 hours in the last 8 months. Know all this coz I researched all about it. Feel free to hit me up if you want any more Info...

If you really want to create a shit storm start filing with Labor Canada, wrongful dismissal.

bigluv 02-03-2011 11:59 AM

Seriously, you come here for employment advice?

1) Find out what the terms of your layoff are. I'm going to take a guess and say that its, no severance, nothing, but they are giving you two weeks working notice while you train the girl.

2) You don't have a job description, so its perfectly acceptable for them to ask you to train the new person.

3) Don't get an overblown sense of your own importance. She *may* not be able to replace you, but there is *always* someone who can and its always easier than the employee thinks it will be.

4) Start putting out your resumes right now instead of crying on GFY.

5) Dont burn bridges at the current place, for so many reasons. One is EI. The other is, get a good reference letter, now. And I would secure your Record Of Employment form from them right away if possible.

6) You don't have a case for wrongful dismissal or any of that jazz, so just put that out of your head. [unless there was some very HUGE part of the story you left out].

And, once again, can I just say, this is the worst possible place to be getting advice from.

Beyond that, I'm curious. How were you generating leads? Craigslist? Or a dealership website.

If you were fired, no EI benefits. If you were layed off, then yes you get EI. However, you should contact EI regardless and when you apply it will ask very specific questions. If they see something fishy they will go after the company themselves and get you mucho mucho benefits if protocol was broken.

As far as I know, In Canada, they cant eliminate your position to keep another employee who thus takes your position if you are meeting all expectations and past the 90 probation period.

iwantchixx 02-03-2011 01:30 PM

Why don't you ask for her job in the meantime? Sales are not hard and you could end up doing better than her.. 80k as a top earner is actually pretty weak if the dealer offers on-site financial services. In a market that size a good top earner can do 200k

blackmonsters 02-03-2011 02:51 PM

Tell the job that you have accepted another offer and cannot come in to train
the other employee.

Then move on.

Ignore advice about "revenge"; they will know immediately that it's you and
you will go straight to jail.

Fuck collecting unemployment, go straight out and find another position like you
are leaving now. Otherwise you will start getting those unemployment checks and
lose track of time and then the checks run out and you won't have the level of
biz that you need online.

You are playing with "murphy's Law" when you accept unemployment.
That shit will go wrong.

2MuchMark 02-03-2011 03:08 PM

Since you know cars & the interewbz, why not apply for a job http://www.teslamotors.com/ ? They're the future of cars, today, they're high tech, and they're hiring like crazy.

Fucksakes 02-03-2011 03:27 PM

today was an interesting day at work.. it was the girls birthday, she went into the office with the manager and told her that she doesnt want to do my job, she was told its a full time job and its alot harder than she thinks.

Im not sure whats happening now, but I am guessing they will be asking me to stay.

btw.. to the reply above.. Im not crying at all, thou if you knew the history of my position and how hard I fought and presented myself to get in the door presenting reports after report to move up from min wage.. I starved for months before getting a decent pay, and I was still in the process of getting paid a % for each lead on top of my salary. all the struggle to get to the top only to be taken away in a heartbeat kinda gives me a good reason to cry, the reason for this post was because I wanted to know if what they did was even legal, and if I was entitled to anything and how to get it incase I dont find a job quick enough.

btw the main boss asked me how I was feeling today and I just said I am fine, after ripping Anthony apart when I quit/he fired me whatever it was, I learned from that mistake.. no need to burn bridges.

I did delete her from facebook.. oh that felt so good hahaha
