“I knew the biggest sharks on the Internet,” says Birbrair, and he called the two biggest, Levi of Cybererotica .com and Warshavsky, who agreed to bankroll Kremen in exchange for 45 percent of Sex.com.

I believe it was originally registered in 1996 by the current owner. It was handed over to Stephen Cohen when he was suing anyone with "sex" in their domain name. It was reacquired by the original owner in 1998 and has been held by him since then.

I think that is the sequence of events although I might have the order of things happening a little off. My apologies for any inaccuracy.

I can state with certainty that the original owner is who has control of it now.
