Ever Been To Prison?

I was watching some kind of special about high-security prisons last night on one of the cable channels and they were talking about violence in the prison system. At one point they showed some video footage of a prisoner getting attacked by another prisoner with a knife and almost killed the dude. That got me to wondering about what responsibilities that the state has to keep you safe after they sentance you to years in jail. And...if the state fails to keep you safe and you get hurt, do you have any legal recourse like bringing lawsuits against the state for failure to protect you against violent persons. Surely a prisoner has some kind of legal recourse for the failure of a prison to protect one, no?

Many times people have sued states over inmates getting mamed or killed.

However if the prison provides "Adequate" security most times these lawsuits are dropped.

You're right, I wonder if you do have any legal options to sue the prison system. You would probably have to have money for your case though

If you die in prison, they just chalk it up for, "Well, if he didn't do the crime, he wouldn't have been doing the time..."

No one could care less. Do you think the court system is going to back an estranged Mother who's butt fucking child molesting son was shanked in the fucking shower? The cocksucker already wasted enough of the state attorney's office time.

You would have to prove GROSS negligence in order to win anything like that, and in order to do that you would need hard proof. Prison guards and officials are like cops, more or less. They aren't going to rat anyone out (unless there is a pot of gold at the end of the rainbow).

If a prison provides "adequate" security and someone get's killed, then the security wasn't "adequate" enough and someone should be held responsible. At least, that's my thoughts on it. ??

i got 2 friends in the state pen that i go see every month or so. They say nothing like that really happens. there are fights but nothing like what you see on tv. Those type are usually rare unless your like in a CA prison. Tv shows just use that footage alot for shock value.

I am trying to remember, back in the 70's a friend of mine had his brother transporting some illegal substance to PA and he got busted.

Being a young kid at the time he was soon raped. I remember there was a lawsuit filed, but I don't remember the results of it. He may have gotten an early release . . . but too many years ago to remember for sure.

I visited a medium security prison with my Crim class. They told us the solitary section was more for the inmates' safety than punishment. They put child molesters and rapists in there, because the other inmates won't put up with them in the regular population. So they have separate exercise hours and eating hours and everything. But who knows, maybe that was just PR spin.

criminals hate criminals...some prisoned man can DO nothing with HARSH inmates...that's really a BIG question how come cops assigned can't do anything...yah know they still have their rights...coz they are HUMAN

to answer dean: the state (of CA) separates prisoners by "levels" which separates the more dangerous from the less dangerous...they also separate by race, gang, and if a person has any enemies he can declare it upon entry to his reception prison and they will keep him separated from those prisoners during his incarceration
