In the states you might be able to get a TRO without proof but to get a permanent one you go before a judge. And you can bet that judge will be pretty ticked off if/when they find out you lied to get the TRO if the defendant hasn't done anything.

All you have to say is you're being "harassed" or "feel threatened" and the order will be granted. Judges rarely deny restraining orders because of how it would look if the person the order was sought against caused harm to the petitioner.

The lawyer simply has to convince her that her 'depression' is caused by talking to him - so he puts it on paper that 'he' (Sleazy) has to have no contact with her. The lawyer also wants to guarantee that they don't get back together.

In Quebec, now, they suggest you go to a mediator before going to a lawyer - you see one person, try to work out a deal between the three of you - if it doesn't work and you seriously want to fight it out in court, then you go ahead and do that.

Sleazy, although I did what you're doing, in the sense that I gave him more than what was entitled to him - I suggest you give what she deserves. If she's entitled to 50% by law - you give her 50% not 75% - also, don't forget you're entitled to her RRSPs too & make sure she signs off to your Canadian & Provincial Pension Plans (or she will benefit from those when you pass as your 'widow' even if you've remarried) .

In Alberta, you don't even need to file a police report or ever press charges. You can just go down to the court house, tell the judge that someone was mean to you & you're afraid - bam! Temporary restraining order for 7 days is served on the other party. He/she has to appear in court to have it lifted.

I can see how someone truly in danger doesn't have time to file the neccessary paperwork & needs it immediately, but the system is very commonly abused in divorce & custody battles.

This is true far too often. It's frightening how many women try to keep their kids away from their dads just to punish the ex for cheating or hell, even moving on & finding happiness! The system is starting to change & reward the parent who makes an effort to maintain the parental relationship on both sides, but it's the line of thinking that needs to change first.

I'm not a lawyer, but "possession is 9 tenths of the law". Moving out of the house and leaving your stuff there may give her "possession", making her claim stronger, especially if the divorce proceedings are long and drawn out. Also it sounds like you put in writing (?!?) your willingness to give her 2/3 of assets... that could come back to bite you later. If you are in front of a judge or arbitrator a year from now going through assets, how are you going to say that something she has been using for a year is actually yours? What will you say when she pulls out the itemized list of assets you gave her and starts negotiating up from there?

It may be worth getting a 2nd legal opinion. Just my
