kind of , what they are trying to say is google is a "public service tool" .. kind of far fetched , doubt it will go far..
heres where the lawyers should have gone with that.. google still spiders penalized sites, thus using the indexed content to increase its value as a tool. So they cause increased server load on your server while penalizing you and using your content at the same time.
