    Interesting... but no. The agreement is with the webmaster that would produce the site... not the affiliates. If Pepsi went out of business... the guys that run the Pepsi machines could not sue Pepsi.

    There's a simple solution to make sure this does not happen to you. Make sure you ask your single girl sponsor how much content he has of his model. Make sure he has at least a years worth of updates. That will protect your recurring. Valid concern however.

            Not a thing a guess. However, most of us have a real interest in staying in business wont have the need nor take the risk of lying. We (and other serious companies) have family and employees to feed. To most all of us... this isnt some game we play on the weekends.

            Just ask: How many sets of reserve content do you have on this solo site? If they dont know what you are talking about... the most likely dont have anything on reserve.

            Just a thought.

                                sorry, u need to go back to your 'real attorney' - u can write whatever u want into a contract but bottom line it is VERY difficult to stop somebody from working to support themselves, contract or no contract.

                                what you can probably do is sue a third party if they compete against you with somebody you have a contract with.
                                I moved my sites to Vacares Hosting. I've saved money, my hair is thicker, lost some weight too! Thanks Sly!

                                        If your non-compete says you can't work for anyone else then no shit it will not hold up. But for going to a competing website then yes it will hold up. Especially if they just leave for no reason.

                                        They agreements can be and are enforced daily. Look at the record industry.

                                                that's what i meant - there are people who are under the impression that a non-compete clause means the model is locked out of working for herself, not a chance in hell any court would side with the employer on that. leaving and going to join a competitor's program is a different thing. and easier to get some kind of remedy from a company that has assets rather than an 18 year old who probably has little or no assets.

                                                        Yeah - all my models I'm working with now have day jobs and I recommend they keep them.

                                                        If one of them went to another program I would file action against both them. Fat chance collecting even your attorney fees on an 18 year old girl but if she ever started making money from another program/site you can dip right into her bank account.

                                                        I try to explain everything to my models before hand. I tell them there pictures are going to be plastered ALL OVER the internet and they may get people that notice them in public places. This way if it ever happens I can say I told you so. Also if they choose not to "renew" their agreement with me they must give me 30 days notice and in those 30 days make themselves available for shooting 100 sets. This will get me plenty of updates to find a new girl to replace her and phase her site out.
