It depends on the law in your jurisdiction. Most jurisdictions follow an "equitable" standard. In California, where I've lived for quite some time, the standard is COMMUNITY PROPERTY. IF the asset grew during your time together EVEN THOUGH THE ORIGINAL ASSET was not your wife's she is entitled to HALF the appreciated value. It will get tricky if the original asset was 'comingled' in some way with other marital assets.... I'd say, speak with a family lawyer in your jurisdiction.
