try to remember that ANYONE can write up a T.O.S. and put whatever they want inside it. There are no laws forbidding how they are worded.

HOWEVER - here is the good part - if what the T.O.S says is in conflict with your rights in your state, THEIR state, the processors state or in the customer service chicks head - you win!

Like someone said, Call their customer service and state your case. I myself prefer emaling as this is 100 percent documented communication and time stamped. But at first contact, I guess you could call; making the assumption you will be treated as an honest person making a legite complaint . If it doesnt go your way on that call, then continue the process thru emails only.

It will be VERY beneficial to you if you can site (or cut n paste) from a specific URL and specific portion of text where what the SALES PAGES promised verses what you experienced AFTER THE SALE. This is especially helpful where the full version of the software was not available for a trial run. And thus you made the REASONIBLE assumption that the SALES PAGES were truthful, but upon payment and then subsequent receiving of the product, found that the sales pages LIED about the state of the software.

The TOS means sh!t put up against that line of arguement
