If you dont read privacy policy/ TOC am i liable?

That all depends on how well your TOS is written. If its vague and falls short of full disclosure , a lawyer would have a field day with it..

My advice is have a "real" lawyer write your TOS and he will write it in a fashion that he feels wont garner him/you legally liable.

Like if you went on a roller coaster they have a TOS on a big board as you get on the ride. If they simply put " YOU GET HURT WE WONT PAY" , its fairly obvious and STRONG , but wouldnt hold up in court.
