Many businesses in this country go belly up and people do not get paid. Here you have a company that is trying to get the money to pay everyone and you threaten lawsuits and piss and moan. Go ahead and file a lawsuit. It would take 2-3 years to go to trial and by that time you will have either gotten paid or they will be out of business. IBill getting caught up is going to depend alot of whether they can get short term funding. At this point First Data is not something I would expect to be resolved in a matter of days or even weeks, its going to take either a bank giving them a line of credit or investors opening their deep pockets. The line of credit would seem to require some personal guarantees, which I am sure put some lead weight in the signature arms of the principals at iBill when iBill was not even able to function domestically. The reason iBill hasn't paid out recently isn't because they don't have the money. The money is being held in some bank accounts that have been frozen while disputes are settled between iBill and the banks. There is no catching up to do, really. And no, I don't work for iBill. Merchant agreements work this way. They can freeze your money if there is a dispute.
So iBill failing to pay out on time means that the company has zero reserves (or is unwilling to dip into them) and is unwilling or unable to raise money to meet its committments. If it is true that there are no funds to deal with contingencies, that is grossly unprofessional at the very least. Whether the payments could be made or not, this is the second time in the past couple of years that iBill have screwed up and passed the full impact of its own problems straight along to its clients.

In all fairness to iBill you should be aware that iBill did not pass the full impact of that problem to the clients. iBill was paying out web900 before they actually received monies from Worldcom. When Worldcom went belly up, iBill had in fact already paid out a huge sum of money. The missing payments were the next payments in line. Of the amount that was owed by Worldcom to iBill, roughly half of that amount was paid to the clients by iBill. The total loss on that fiasco was closer to a 50/50 split with the clients eating half and iBill eating the other half.Originally posted by jayeff
