It's not whether they are really nude in the bath tub but whether or not the audience is LED to believe they are.

Ya know, I think there is a simple answer here.
I am sure the movie studio consulted with a very high paid team of smart lawyers, etc. to make damn sure that whatever they did with this bathtub scene was above approach and totally within the confines of the law.
Do you honestly think that any major motion picture studio and an actress of Nicole Kidman's stature would seriously release any type of movie with a scene in it that could cause them a legal headache? Especially when it concerns a child?
Use common sense. If it wasn't legal, it wouldn't of been done! It may cause some controversy, but there has been other movies where a parent was in the tub with a child or infant. Like perhaps, "Three Men And A Baby".
Not everything involving kids is child porn, ya know.
