    The Hun loses UDRP over hun.com

    The Hun lost the UDRP over hun.com:

    It'll be interesting to see if The Hun decides to appeal that ruling in real court, where he can do things like "discovery", to get documents from the other side, etc.

    Given the discussion in the original thread a few months ago:

    there did appear to be some elements of bad faith, e.g. the use of the words "Yellow Pages".

    I dont think he had a leg to stand on. Kind of like when Steve Cohen went after everyone with sex in their name. www.hun.com looks nothing like www.thehun.net

    Bit pathetic really.

      I havnt read the other thread.... but simply from the documents posted I think it was a good decision. :2cents:

        Wow, I'm surprised Thehun lost. For years, the guy who owns Hun.com has had his site with a yellow background and blue hypertext links just like the thehun.com to confuse surfers. It's funny, because now hun.com has changed the look of their site and blocked archive.org as to not incriminate themselves.

        "We're sorry, access to http://hun.com has been blocked by the site owner via robots.txt."

        As mentioned by the wipo panel, "The Panel notes, however, that because a likelihood of confusion seems to exist, the Complainant may have additional rights and remedies under national trademark law if it can provide actual evidence of the assertions made in its Complaint and the supplemental statement."

        I feel thehun.com can win this one in court.

            Woah ... that's gay ... he should get the domain since most of the traffic is related to his site. The site must get at least 50k typeins a day

                  This will be a wakeup call as folks fight for generic names on .xxx, if they have no trademarks or only very weak ones.

                      fair decision. if the domain is a generic word or even in another form, no tm can protect it. fact that hun was there before thehun filed for his mark is an even stronger case for hun
