sad thing is they'll probably get away with it unless someone reports them or they spam it and get noticed by the authorities
that's the 'beauty' of herbal products - they're unregulated by the FDA (though that will be changing no doubt - they already have new shipping notifications in place when sending herbal (and some other) products to the US)
if you post testimonials on your website that are false, misleading etc.. then you can most definitely get in trouble for false misrepresentation of a product, PARTICULARLY if you are providing medical advice/suggestions (especially when you're not even a doctor/medically trained professional etc) that can put someone's life at risk (as is the case when a diabetic goes off their medication) - such charges often result in large $$ fines and sometimes jail time (though it has to be something extreme for that).. (and don't forget, the govt can seize your docs/records/sales info etc and whatnot so if you're making false testimonials they WILL find out under investigation)
I'd hate to be the manufacturer/distributor of this product if/when someone is blinded by the 'sell' of it and replaces their essential meds with this and ends up dying. That certainly wouldn't be a good situation for anyone involved.
(I'm not against herbal remedies, some of them can be very beneficial and helpful in CONJUNCTION with prescription medications and etc.. but to imply that a herbal 'remedy' can do the same job as a prescription med when the herbal hasn't been tested/researched/etc through the same procedures as a prescription drug would have to go through seems wrong to me

)
