Pot grower faces murder charges for firefighter deaths

PHILADELPHIA, Pennsylvania (AP) -- A house blaze that killed two firefighters started in a tangle of wires and lamps that were installed to grow marijuana in a basement closet, authorities said.

The man who police say was responsible for the drug operation was charged with third-degree murder.

Fire Capt. John Taylor, 53, and firefighter Rey Rubio, 42, died Friday when they were trapped by quick-moving flames while trying to find the source of the fire.

Fire officials said the fire started in the wiring set up to run the lamps and fans used to nurture the plants, and spread more quickly because the hot lights had dried out the wood in the closet.

In addition to murder, Daniel Brough, 35, faces charges of marijuana possession, involuntary manslaughter and causing a catastrophe.

Philadelphia District Attorney Lynne Abraham called Brough "reckless," "foolish" and "greedy."

Taylor, a 32-year veteran of the department, and Rubio, who had been fighting fires for 12 years, appeared to have died of smoke inhalation, officials said.

How is that murder? I could maybe understand it being manslaughter or criminally negligent homicide, but murder?

Murder is the crime of intentionally causing the death of another human being. They think he intentionally caused the fire in the hope that it would kill someone? Am I missing something, because that sounds extremely unlikely.

The fire wasnt caused by a crime, it was caused by wiring. I bet he's found not guilty.

So I take it if the electrical fire had been cause by too many things plugged in his entertainment system the murder charge would only be if he had a hacked satellite access card?

I learn something new every day

                            Felony murder statutes
Many jurisdictions in the United States have also adopted felony murder statutes, according to which anyone who commits a serious crime (a felony), during which a person dies, is guilty of murder. This applies even if one does not personally cause the person's death; for example, a driver for an armed robbery can be convicted of murder if one of the robbers killed someone in the process of the robbery, even though the driver was not present at and did not expect the killing.

If weed was not present, the firemen would of just died during duty? Add some weed and it's murder? That's fucked up.

And if a fire breaks out in say... A pedos house and the firemen die while pedo material is in the house, the pedo will be charged with murder because it just became a crime scene?

So.... if we start fires at all the pedos houses...

I think this is a little different then being the getaway driver for someone that murdered someone.

If a fire starts accidentally and the firefighter dies.. I don't see murder. Don't you have to have INTENT to kill someone to get murder? Causing someone's death without intent is manslaughter..

I dont think the murder charge will stand up.

                                            That arguement is silly dude.

The guy was commiting felony cultivation, while doing his job , the fireman, had to put out a fire that was created by an illegal activity. Its unfortunate that he died, and im sure the grower feels like shit that someone innocent died for his crop.

But he is responsible for the mans death like it or not.

The guy was commiting felony cultivation, while doing his job , the fireman, had to put out a fire that was created by an illegal activity. Its unfortunate that he died, and im sure the grower feels like shit that someone innocent died for his crop.

But he is responsible for the mans death like it or not.

This was not an intentional fire... it was an accident that just happened to be caused by LAMPS, which last I checked were not illegal. Growing, selling and possession of marijuana is, not having the lamps that grow it.
