I can't believe I'm the first one in this thread to bring this up...
The law is all about interpretation, and in order to be upheld in courts, it needs to be consistent with the constitution.
What happens in court cases like these is not that lawyers and judges take a look at the lawbook and say "Indeed it's there".
What the mayor in question did was not decide that from now on it should be legal for gays to marry... he decided to provoke a lawsuit in which he hoped the law in question would be invalidated.
Quite obviously, in this case the main focus of the court case could have been to decide whether or not the law in question was illegal discrimination. (the reason many racist and sexist laws have been invalidated in court)
That didn't happen though.
The court did not decide that the law indeed was invalid or valid, it just decided that the mayor's actions overstepped his authority. The prosecution basically didn't have the balls to focus on the matter of the validity of the law but instead went for a technicality.
For those saying "people should try to change the laws instead of just breaking them", laws ARE changed in court. For example, many laws against gay sex which were supported by a majority of the people (and thus had no chance of being repealed by politicians) have been invalidated in courts for being unconstitutional./(bb|[^b]{2})/Comment
