It seems to me there're no worries if you live outside the U.S., as the law cannot reach you. However, it also comes down to the content producers who are starting to tell everyone to remove the hard content or replace it with soft, and if you don't comply, your account will be cancelled. It's funny to me that many producers, such as Karups and Lightspeed, are not allowing ANYONE to continue to promote with hard content, since non-u.s. based Webmasters could still do so without violating the new reg.
We're restructuring our affiliate program to have zipped soft and hard content, so there will be a choice for American and non-U.S. based Webmasters. I don't know how the soft versus hard galleies will convert, but I'm thinking it will probably be a nice edge for European Webmasters. And is that unfair? Look what country passed the law...
