What is google going to do with their image search...?
If they don't do anything, neither need you... as long as it's just thumbs.. I am only speculating, ofcourse.CheapAssDesigns.com - when you need quality designs at affordable prices.

actually..i just started a new tgp... www.muddythumbs.com ....everything on there is remotely hosted.
The thumb table is a plugin from Nubiles.net ..very smart idea.
so the 2257 won't affect that TGP at all.
But on the other hand, my first tgp, legally18.com ...it will be affected. I might have to go to text only, or crop around the face.Comment

It won't be hoseted by google, thus they are not responsible.Originally posted by Broda

Hate to bust your bubble on this, but you are wrong. I thought the same thing initially, but had a lawyer hit me with something that is now obvious:Originally posted by TechNtentions

(2) A secondary producer is any person who produces, assembles, manufactures, publishes, duplicates, reproduces, or reissues a book, magazine, periodical, film, videotape, a computer-generated image, digital image, or picture, or other matter intended for commercial distribution that contains a visual depiction of actual sexually explicit conduct, or who inserts on a computer site or service a digital image of, or otherwise manages the content of a computer site or service [JDO: No "commercial" purpose included here.] that contains a visual depiction of, actual sexually explicit conduct, including any person who enters into a contract, agreement, or conspiracy to do any of the foregoing...
Hot linking / linking etc, places you in the "enters into a contract, agreement,or conspiracy to do any of the foregoing..." category. It is vague as hell - on purpose, and that is their catch all.Comment

They dont have to do anything because they are only providing links..... The new regs say if you insert content onto a computer or otherwise manage one etc, but courts have already ruled that linking to other sites isnt the same as hosting or "managing" something yourself. The difference is rather obvious.Originally posted by Broda

Almost every single thumb tgp i have seen is illegal..
Buying some content doesn't give the LICENSE HOLDER the permission ( or anyone else ) to display the pictures on multiple domains ( unless otherwise specified ).hatisblack at yahoo.comComment

If it was simple, we wouldn't be having these debates and there would be no need for lawyers...
Basically, the way my attorney and I now understand it:
To display any graphic / sexually explicit images whether they are on your server or elsewhere, say... a sponsor's server (and you are merely hotlinking), you are still a secondary producer and therefore need to comply.
The hotlinking falls under the contract / agreement / conspiracy clause.Comment

Actually I'm pretty sure there was a case in the past where the court ruled that using just thumbnails fell under the fair use provisions of the copyright laws.Originally posted by SmokeyTheBear

Of course that doesn't make the sites legal regarding 2257, but I'm pretty sure it covers them on the copyrighted content issue.sig too bigComment

Yes, ofcourse that tgps need to comply, this is already understood.Originally posted by Lycanthrope

I dont think a tgp like madthumbs will trust submiters to hotlink from them....
my question is how are they going to comply....Comment

say goodbye to the little guys.
And make sure your sponsors host your promo content or galleries and are compliant
SIG TOO BIG! Maximum 120x60 button and no more than 3 text lines of DEFAULT SIZE and COLOR. Unless your sig is for a GFY top banner sponsor, then you may use a 624x80 instead of a 120x60.Comment

Hey.
This effects google just as much as it does me.
Google's Hardcore Category
Mad Thumb's Hardcore Category
The difference?

You're telling me that google's thumbnails aren't the same 'content' as madthumb's thumbnails, and that they aren't 'inserted' in the same way?
And for everyone in this thread that has said 'crop it around faces' ... that's not correct. You can show full nudity if you want ... the only thing that falls into 2257 is sexually explicit.
Myself, if I had it my way from the beginning .. ALL of my thumb tgps wouldnt show a bunch of dicks, fucking, cum, etc .. but would show some faces/tits/ass etc .. but not the whole shabang .... this does NOT hurt productivity, it actually increases it because the surfer will click more (not knowing whats on the other side) ... it's the same as using a gallery to lure a surfer to a paysite ... the thumbnail on a thumb tgp should be a sample that does everything it can to peak the interest of a surfer. Pretty simple.
Anyhow as of September 24th on MadThumbs:
a) You have to submit softcore non-sexually explicit thumbnails.
b) You have to censor the hardcore parts out of the thumbnail.
c) For a paid listing on the mainpage that actually wants to continue submitting hardcore, they have to provide the documents I need to be in 2257 compliance.
Regardless, this is all hypothetical. I've got several legal questions about all of this that can't be answered untill some precedents are set.
Like someone mentioned above, how are they going to hold be liable for 2257, if copyright law makes 88x88 thumbnails legal?
Doesn't make a lot of sense, but we'll see.Last edited by madthumbs; 08-11-2004, 09:19 AM.Comment

Yep... as long as it's not "sexually explicit" content, it's not going to be a huge issue.Originally posted by BVF
