2257 ... non published pics?

    2257 ... non published pics?

    I have a question that may sound stupid, but i am just not sure about it and want to be safe. I have tons of images on my compter that have no docs, these are images that were given to me to build a site, banners, etc.. and also my GF has many many photos from TFP shoots and other shoots where the producer allows her to use certain pics for her portfolio's.

    Now i do not publish any of these photos, but they are on my computer, i just want to make sure that there is not some stipulation to were they come to check on my records and then they decide to give me a hard time about photos on my machine that were for these purposes. 2257 is only for published images correct?

    Our Attorney's said no docs in house and on file delete the content and remove from the premises all records of it by the 22nd of June

      Correct! Tho the law have been known (usually motivated by a prosecutor) to change the goalposts and slip in material that helps their case, tho it may have nothing to do with it in reality.

      It "could" be argued that if you have a box with images and you are a webmaster - that these images are being used or intended to be used for web publication :-)

        This shit is really starting to confuse me & piss me off, what about the fact that my GF is a model so she has her own "non-published" portfolio of her work, some prints, some digital, and some video. So now she had to get rid of all her work becuse her does not have docs for it?? the pics are of her and she is here to prove her age? So now a model cannot have a portfolio of her oen work??

            Sure, some of it is. But again it is not anything that is published anywhere, She just keeps copies of all her work for her own purposes.

            Also we have some pics blown up into large photos and they are hanging on the wall, we have copies of magazines she was in,etc...

            Why should this matter??

              By that same logic that surfers who save pics/movies would be required as well, which doesnt make any sense.

              This is my armchair laywer speaking but in my assesment you would have not need for docs.

                that is what i am thinking also, what are they going to do, say hey you have a penthouse mag, can i see the docs for it??

                    Then again, one could say that they could go after any copywritten pics that just so happened to be saved locally (not that anyone ever does that ), a few Usenet MP3 files..oops, that copy of Winzip that was registered under a friend, some burned movies, etc... etc.. It's gonna be interesting.

                      However..

                      If they can check a PC or server for 2257 violations, and they find other infractions, they can charge you for those.

                      My view.. if your PC is subject to inspection because of 2257, clean it.

                      Think copyright infringement, etc. If the proverbial "they" have a hard on for you, 2257 could be a doorway into anything.

                            If you keep you files in paper form with CDs to go with, then you can just give them the file cabinet when they come and they'll have no reason to touch your computer.

                              This is EXACTLY why you want to do the following:
                              1. Have a STAND ALONE computer to handle all of your 2257 record keeping.

                              2. Clearly label the machine as your 2257 record keeping computer and keep it separate from your other computers, preferablly in another room (I would recommend a small closet with a 15 watt light bulb and no chair). Keeping it separate keeps the 'plain view' rules from coming into play. They don't have any authority to inspect any other computers on your premises if you have a stand alone computer designated for 2257 record keeping. (this was stated by the FSC attorneys in SD last week)

                              3. I know it sounds unrealistic, but, preferably NOT connected to your main network. If this means you have to get a separate DSL or Cable broadband connection, to connect to the Internet then do it that way... better still, for purposes of inspection, get a dialup account. Make it painful for the inspector to be there, but do it in such a way that they can't say you are being an obstructionist.
