No, they'll just pull his servers, his domains, his affiliate accounts, etc, although it isn't likely they'd come after him will all the other US-based idiots that won't be in compliance.

I know a great host in Slovakia. They have other laws there. They dont need to give out any information about you, your sites or the content you have at your servers.

He's not a US citizen, US law does not apply to him. Worst thing that could happen is they seize his domain names, but we all know how unlikely that is to happen...
