    Another 2257 question

    If websites have to comply with these new 2257 how come brick and mortar stores don't WTF is the difference? Just because a video says on the box "all the models are over 18" how does the store owner know that? If this law is really about portecting children from being exploited then one would think porno shops would also have to have model ids and releases too. Law seems biased to me. Perhaps another avenue for a suit.

      Because store owners practice MERE DISTRIBUTION of said videos.

      Now, if they grab a bunch of boxcovers and REPRODUCE them to make posters out of them... well, they would then be forced to comply.

        No I don't. It's just bs legal mumbo jumbo. Me selling porn DVDs online is NO different than if I opened up a porn shop on the corner.

            Yes, those provided by the video PRODUCERS. Not REPRODUCTIONS done by the store.

              Have you seen the law that was actually signed? Isn't it a little silly to be worked up over this before you even know what "this" is?

                I'm not getting worked up. I'm just throwing things out there. If that bothers you oh well that's your issue. Funny how people in front of a computer can tell what emotions I'm feeling. WTF?

                My point is anyone here that can seriously say that there is difference in REALITY and not in some bullshit legal way in an assine atempt to get rid of interent porn then go right at it.

                  So can the public still not SEE them? Isn't that the point? You have to have the docs stating this chick is over 18 on your site because according the the rules it's to make sure some 17 year old isn't going to be exploited. Well how is that different than hanging a poster in porn shop. If the girl in question is under 18 WTF is the difference? Except in the case of the porn shop you exempt from prosecution becuase you didn't "produce" or "publish" the poster?

                      I'm talking about the stores that sell said books, mags and vids. Not fair the the owner of on line porn shop has to comply but one that does the EXACT SAME THING, but just used a physical stoere doesn't.

                      If the supposed goal of this law is to make sure underage kids don't get exploited then it's silly that an online store owner can be prosecuted if he can't prove if the models on the box covers showing on his site are over 18, but a owner of a physical store whose box covers are exposed for everyone who enters his store to see doesn't bear the same responsibility.

                        I don't have the text of the propsed regs handy, but mere distribution or transmission of content does not make you a secondary producer, so both the corner video store and the online dvd store don't have to do anything.

                        BUT - if the online dvd store was given promotional content for a video including the boxcover and assembled an ad from it, then yes, they would have to maintain a 2257 file on their work for any hardcore pics shown.

                          umh...

                          FHG are and free content are provided by the PRODUCERS to me (example: Nasty Dollars who shoot their own content). So what is the difference?
