Never pay for your designs in full until the project is complete. Either Zero upfront or half.

You can't rush creativity.

He's kept you up to date. He's only a few days late. It's fair to ask for a partial refund (you might not get it) but it's not fair to ruin someone or start drama for something to silly.

I'd say be thankful you were kept apprised of the situation. Sometimes things take longer. Does it make it right? No, but at least you are in contact with him. If he puts it off again tell him thanks, but no thanks and ask for a refund.
