I've been seeing threads all day long about..

The "NEW 2257 REGULATIONS" and oh my god, we need to comply immediately and the sky is falling..

Did everyone miss the big [Proposed Rules] or the SUMMARY: This proposed rule amends the record-keeping and inspection
requirements of 28 CFR part 75 to bring the regulations up to date with
    current law,
    part?

I'm seriously put off by one content provider who's going around starting the majority of these threads to strongarm business for themselves, you should be ashamed of yourself Paul. If it happens, it happens, if it doesn't, it doesn't, don't try to use your bloody scare tactics to drum up your business.

This industry amazes me sometimes, are there ANY professionals left?

I dont think that jumping down Paul's throat is the right approach here. He isnt trying to drum up any business by doing this. He is trying to get your collective heads out of the sand. This is an important issue. If Paul wasnt doing this, most would not know that this is even happening. BTW, he isnt the only one trying to make webmasters aware of what might be coming down this pike. Did you also notice that there was an address to which you can comment on these proposed changes?

Did you comment to the webmasters telling to respond to Ass hahaha by telling him that these changes might not be needed?

No, you didnt. So get off Pauls back and try to do something to better our community.

Paul didn't once say that these were proposed, he said people had best get caught up with the new law, there's a big difference between keeping people informed and giving them misinformation, especially when you can personally gain from it.

While you sit there and blast me for not telling webmasters that they can comment on it, you ignore the fact that neither did Paul? Get off your high horse and stop kissing Paul's ass.

if you were falling, wouldnt the sky be ascending relative to your descent?? So technically the sky wouldnt really be falling if you were....

Perhaps....But I don't have a clue who you are. What I do know is that you do not live in the US and therefore you are not subject to US laws. I don't know if your required paperwork and releases are in English, Russian, Czech, or Marshan and if they are in English....Do each of your models understand what they are signing.

No, you didnt. So get off Pauls back and try to do something to better our community.
Pull your head out of your ass. Paul has been preaching his "We include all docs" speech for a long time now. He does it as a business tool...PERIOD.

There is nothing wrong with the way Paul delivers his product but the way in which he chooses to market it is what Jact is questioning here.

I've been very outspoken on 2257 issues but you don't see me using it to spam my content.....Mostly because I don't want to do business with the majority of you idiots.

As an industry, we're very resilient and we can adapt to nearly everything that's been thrown at us. If indeed these regulations are passed, we will adapt, but until then, the sky isn't falling and the writing isn't on the wall.

I know personally, I don't want to give out unedited docs to the newly defined "secondary producers" for a $5 set, so I will discontinue non-exclusive sales. Not because I don't have docs, but because I didn't get into this business to possibly endanger a girl's safety for a $5 sale.

I'm totally with you on this.. There is no way I could sleep at night knowing the danger I was putting girls in handing that shit out like candy. How many surfers stumble on content sites and buy pictures? I've heard it happen a LOT of times.. I've had girls who were stalked before too (someone they knew found their pictures, it wasn't rom docs), and it's an experience in terror unlike almost anything that you can imagine. And then to hand psychopaths everything they need to find victims? No way. I'd rather drop all non-exclusive sales then threaten the lives of girls like that.

First off....I hope the regulations are passed. 2257 was written pre-Internet and an updated version is long overdue. Usually people bitch about being in the dark because they feel that the current laws are not written clearly. Now people are concerned that there is a big "crack down." STFU, comply with the law, and move on with your business.

Secondly.....I feel the same way that you do which is why I stopped aggressivly pushing non-exclusive sets a long time ago. It is also why I am very picky on who I do business with. I personally know each of my ongoing exclusive clients and I fully trust them with those records.

Jact, I agree with you concerning giving out personal info on models. We have always given proof of age verification on all our sets. The info concerning their address or other personal info would be blocked out.

I dont think that you should stop doing $5 sets. I dont think that the new regs should change any of our business models. As has been said, we are resilient and will adapt faster thatn Ass hahaha thinks we can.

Oh I completely agree, it would be good for the industry to finally have some solid definitions to follow instead of guessing what the law might mean tomorrow if enforced. I think they've broadened the scope of who can be considered a secondary producer a little far (The way I read it, it looks like a server admin can be considered one -- I may be off on this but that's how I read it anyhow), but it will be good to finally have some definitions.

People have used the argument in the past that they have to give the documents to magazines when they print, well, a magazine isn't a stranger coming in off the Internet who may or may not be what they represent, they definitely ARE a magazine and they definitely ARE accountable. With so much fraud and cheating and sketchy activity, in the non-exclusive game, you can never be quite sure who you're pushing these girls information to. I would have no problem giving unedited docs to people I knew were what they seem to be.

My understanding has always been that "Secondary Producers" must be given unedited documentation, which means no information blacked out. If they broaden this to include the Tom, Dick and Hairy webmaster, then I'd be seriously uncomfortable giving them this information. I already do provide blacked out documentation to those that request them, that isn't an issue, it's those black lines that give me peace of mind. Remove my ability to keep those there and I'm not feeling it anymore.

What I do know is that you do not live in the US and therefore you are not subject to US laws. I don't know if your required paperwork and releases are in English, Russian, Czech, or Marshan and if they are in English....Do each of your models understand what they are signing.
thats right, we're not a US company and normally we can give a fuck to US laws. But our customers are US websites and this is why we take care of them though.

And most of our customers for which we do exclusive shoots provide us their own papers, which are always in english.
And we explain them to the models.

We also have scanned all model releases from the past and we always did pictures of the girls with id-card and passport.
So even our existing content is compliant to US laws.

we might be not very long in this business, but so far our customers seem to be quite satisfied with what we are doing. and I think they would have complained if we were doing shit.
