Teacher's cannot physically restrain a child except maybe to protect themselves.
Even teacher's who deal with violent or mentally disabled children in special classes have protocols that they have to follow in order to not be brought up on criminal or civil charges and eventually lose their jobs or worse.
This child apparently has issues. It's quite apparent..and this is not just a temper tantrum of a 5 year old. If your 5 year old is having temper tantrums like this then you are a horrible parent for not either stopping the situation or getting the child help.
Should the child be arrested and cuffed? That's a police issue. But I think if handled right this could be something that makes the child stop and think before she acts as if she's in control again.
I hope the mother loses, but I seriously doubt it. I'm sure it will be settled out of court to silence certain sectors of our society...those who live their lives as victims.

I hate to say it but I think this will not help the girl. I say that because the mother is suing and in order to do that she must paint her daughter as a vicitim. So she is already instilling the "i'm a vicitim, the world owes me something" mentality. If she loses ( and I hope she does ) she will probably blame it on race so she will be instilling the kid wit racism as well. I feel for this little kid but I think the school should sue the mother for sending a kid to school that is uncontrolable.
