                The fact that they have included text in the law is part of the extremely overbroadness of it. That means that newspapers, magazines, health sites, forums, and any number of other mainstream sites that have nothing to do with porn would be illegal.

                It's obviously unconsitutional as written. Hopefully the Supreme Court will agree with other courts who have ruled just that.

                  This is just another piece of shit that the US is famous for - "control". There is fundamentally nothing wrong and plenty right about protecting children. The next stage is implant em all with an ID chip at birth and bung them a cellphone with a location tracker in it - all for their own good of course, - in case they get kidnapped or lost.                           The outcome of this election will determine in who the replacements are and the future of our rights.

                            IMO if it goes our way there won?t be new legislation like COPA of the CDA. Essentially what the court is going to have to say if it rules in our favor is that in dealing with this problem (keeping adult material from children) regulation isn?t the solution because there is no way to single out porn sites for age verification without including a whole bunch of other sites that deal with a wide range of topics. I would suspect the government would put more effort into the obscenity Prosecutions.

Even if the USA outlawed all porn, and put every smut peddler in prison, the net would still be full of porn from other countries. All they would accomplish is putting US smut peddlers out of work, loss of tax revenue from porn sales, and increased cost of housing prisoners...Insane

                                        They are using the patriot act to round up anyone in the US that is a green card holding immigrant, that has ever had so much as a parking ticket.                                               There is no saying what they will do. A few years back, I was totally naive about the US until I lived there. After having lived in a few countries, it hit me in the face how "restricted" it actually was yet at the same time proclaimed "freedoms". There is a law for everthing from breathing to thinking and as a result more incarcerations than any other county.

                                              Some facts already show how restrictive it is - US citizens have no "rights" to move to other countries and not account for themselves at home. They may not, eg. visit countries on a US blacklist (without clearance). If they want to give up citizenship, this may not be granted - they hate dual nationality and infer that it is "illegal"!

                                              Gaming sites are "illegal" in the US and why not porn? One reason may be that money is involved in gaming and they are not getting their cut of internet gaming. This has resulted in propaganda about crimes of money laundering and a load of other shit re gaming. Some is true - most not - you can create the same story about any biz, including porn, and create an "anti".

                                              There is also this motherly tendency for the govt to let it's citizens know "what is best for them" and in their own interests - all bullshit.

                                              The Supreme Court will make a judgement, whether this is favorable to the adult biz or not. I saw this comming years ago, tho had no idea of the angle it would come from, - and moved everything offshore into a more friendly environment for the adult biz.

                                                That argument works when companies arent loading up email boxes regardless of age with porn pics ads. Using mainstream domains like whitehouse.com Also over the top tours didnt help this, everyone with this didnt care about tomorrow fuck them I will do what I want attitude and now they are scared .                                                   The fact is that the people who proposed this law are religious extremists and they are no different to the religious extremists in any other country in the world.

                                                  They don't care if they infringe on your civil liberties - they don't care if they trample on the consititution - they don't care if their laws restrict your access to life-saving medical information.

                                                  All they care about is forcing everyone into their narrow little view of what is right and healthy.

                                                    I'm pretty sure it will be struck down. There are two major flaws in it. First it is so broadly written that sites like Amazon and breast cancer sites will be effected so it's too much of a blanket. Second it doesn't call out any real legitamate forme of online age verification.
                                                    Previous courts threw it out because they say a credit card isn't really age verification ( when I was in disney world a couple years ago I saw a 12 year old girl with a visa debit card ) and that forcing the use of a credit card as age verification is wrong and restricts access to adults. I can take my drivers license and some cashe and go buy porn in any porn shop in the country and I never have to have or use a credit card.

                                                    So I think this will be struck down because it is just too flawed. However, regardless of who wins the election ( and lets be real for a second Kerry is much better for us than Bush if only becaus Ashhat will not be in the picture) there will be a nother law like this one written and as soon as congress gets balls enough to list, in detail, what type of stuff should be restricted you can expect it to get voted in and very possibly be upheld in court.

                                                    Also, moving your server offshore will not protect you unless you move with it and plan on not coming back to the states. How many webmasters really will pack up all their stuff and move to a different country? I had read that only about 50% of the adults sites on the web are US owned. . . so only about half the free porn will go away. Sites like The Hun will get bigger and those who are little guys that do 3-6 signups a day will most likely disappear. Many affiliate programs may not disappear, but will take a huge hit.

                                                        I dont think alot of people wouldnt be touched , how are they going to go after every one and then they have to win. Also you are assuming everyone is following this . There are tons of little USA webmaster's that know nothing about acacia or copa. They do their little site , dont network or go to shows or the boards. So there wont be this massive shut down. The big sponsors will have to clean house because they will be a target.

                                                            I've wondered that myself. I wonder how many webmasters are out there that don't read boards or anything and have no idea what is going on. It will be a rude awakening for them when they get the knock on the door.

                                                            As for affiliates I think it will be really tough on them especially at first. I would be interesting in finding out from a big affiliate how many US webmasters they have and what % of their traffic/sales come from those US webmasters. If you have 200 webmasters that only send you 5 sales a months and they just stop that's 1000 sales. if you have a 50% rebill rate on those 1000 @ $35 a month that's over 17K lost just from the smalll guys.

                                                            anyway, I don't want to sound like the sky is falling or anything, like I say I really doubt this will be allowed to stand but something like this is most likely in our future.

They hold them in jail, and either deport them, or release them after about 90 days. Some, like cubans that they can not deport, are being held way over. For instance. A lady that used to live near me did 1 year probation for shoplifting 10 years ago. in august 2003 they picked her up ate 6 am at home and held her for 7 months. They say that it is a moral terpitude crime.

                                                                        I agree that its easy to click the ENTER button but you cant just say... they came there because they wanted. I think that its really a good stop sign and show.. morality. Wish this industry have less and less of. Take this case for example, I bookmark XXX and on the same computer my son has a bookmark of some pokémon site. If he get curious and click my XXX site, atleast he has a choice to leave... and that is probably what he will do if he hasnt made puberty yet.

                                                                          Lars, I took a job offer I could not pass up in the Caribbean back in 2001. I saw that shit was gonna get bad in the US econmic wise. I was there for 2 years and looked at the US from the outside view. I get back and I cannot believe what is going on here. I really am thinking of moving to Canada for a year or two and see what turns out with the US. My biz partner lives in Canada so it's not a big issue for me to go there and live and try out some Canadian trim;)

                                                                              I remember when I first started surfing the websites warning page was pretty much the warning and that was it and until you click enter you didnt see shit. People have gotten lax on that.

                                                                                    why do the courts need to even mess with the internet? Anything they do just makes things worse. For example, can spam. I can spew out millions a day right into hotmail and when microsoft calls my isp to tell them to unplug me they just say im can spam complaint and thats the end of it. Not to mention this "anti spyware" bill makes spyware legal as long as you tell people what it does. Most people are quick to click "i agree" on a website or program they are installing without reading the terms. Hosting your site offshore may or may not do the trick but most porn companies are based in the usa so they would need to setup an offshore ibc. But when you do that the whole irs/tax problem comes up
