I've said this before, and i'll say it again. Warning pages don't mean shit; legally or morally. They're a waste of html. The only good a warning page ever does is having one more banner filled page between the surfer and the goodies.Originally posted by maxjohan

What really sucks about this is that Visa just decided recently that they didn't want to be in the age verification business.
COPA says we should use a credit card for age verification but VISA won't let us so we're pretty well fucked if its upheld by the court.

the only really sensible way to protect kids and anyone else who does not want to see erotica is browser filtering. (ICRA, etc)
it is simple, international, and effective.

It would rely on private companies appointed by the government to decide what is allowed to be published on the web and what isn't. They would be telling you that you can only show content which Visa and MC approve of.
Got fisting? Well if Visa and MC decide they won't process fisting, then it cannot exist on the web anymore if this passes.Comment

I think that the submission was that the warning with no way of preventing access by minors or no verification of age was worthless and did nothing to protect the webmaster from prosecution.Left intentionally blank ... just like my brainComment

Although i agree that the US ( or any other government ) should not regulare internet and censor its content, id' say a law basically punishing those in the US who public free content wouldnt be bad...sure, most of them would move offshore and the rest of the world wouldn't care about this law anyway......but such a law would cause that the credit card companies basically coulnt ban porn, sicne the credit card would be required to get acces to online porn.
The US governemtn may want to eliminate online gambling but they know that they cannot eliminate porn at all....so they want to regulate it...and when they regulate it by making TGP' ying a crime, then in some way they encourage paysites or age verification services......and that's why Visa and MC wouldn't be able to ban porn.

If you operate your business from the US on servers offshore in gaming you're subject to arrest currently and can only avoid it by staying in a country that has no extradition treaty with the US.
Under the Patriot Act they can nab you in foreign countries now. The FBI has 45 offices outside the US for this express purpose.
So you can run, but you can't hide anymore.

Use htaccess to load up an AVS join page on entry to your domains perhaps. Quick and compliant if push comes to shove..WTF are people who've built hundreds of free sites going to do?
Warning pages, to my understanding, are and always have been considered a "good faith effort" to keep out minors. While not an age verification by any means, it's something that adds to the argument that you're doing *something* to try to keep it "adult only".
While it's such a grey area, we should probably always be asking "how defensible is this?" before we put up any page.
This thing as it's written is far too broad as people have pointed out. If they rule in favor, then they'll have to make a ton of provisions..Comment

From what I have read previously, this law, if it is allowed by the Supreme Court, would be in effect retroactive to when it was first signed.
Everyone who has run a free site since it was first signed, years ago, would be in violation and they could arrest you anytime they want.
Almost everyone in the adult industry, and many other webmasters and business not in the adult industry, including Lensman for running GFY, would become a criminal if the Supreme Court rules for this law.Comment

But, then again, I agree with those who say, ultimately, this will not go through....at least not at this time.

The answer to your question is that COPA contains an exception for directories. That exception may be big enough to cover link sites, too -- but what are they going to link to?

Do you know what bugs me? Once again the gov't is putting the responsiblity of the webmaster/sponsors etc. to keep children out of adult orientated websites.
One question: When is someone going to have the balls to stand up and tell all those whining parents who complain that their kids are viewing porn on the Internet to MONITOR their childrens activities.
Parents use the Internet as a babysitter. They buy little Frankie a computer, put it in his room and are pleased as punch when little Frankie only emerges from his room to go to the bathroom and grab something to eat. They don't monitor what websites he goes to and if by chance they find out that Frankie stole their credit card and used it to join a porn site...they flip out! They blame the porn industry for not keeping their child out. Well, it is THEIR fault. If they were to take the damn computer OUT of the bedroom at put it in the family room and walk over to the computer once in a while and actually CHECK what they are up to then there wouldn't be the problem.Comment

I am surprised about how few webmasters understand this law. First off if the law is upheld it wouldn?t simply require censored tours. In order for the court to create a law that tours are censored they would have to rewrite the entire statute, which isn?t going to happen. The law as it is written requires much more than censored tours.
In order to be legal your paysite tour would have to be censored to such a degree that it would be incapable of titillating a 12 -13 year old boy. The standard is based upon the prurient interests of a minor not an adult (unlike the obscenity standard which is based on an adult). In other words if the material taken as a whole, lacks serious literary, artistic, political, or scientific value for minors (not adults) it is out of bounds. When I was 12-13 years old National Geographic and the ladies underwear section of the Sears catalog met that definition. Furthermore pay particular attention toHere is some of the actual text:

The term ''material that is harmful to minors'' means any
communication, picture, image, graphic image file, article,
recording, writing, or other matter of any kind that is obscene
or that -
(A) the average person, applying contemporary community

For example if you run a chat or a BBS and allow people to post things you could be liable if even 1% or less of your content dealt with a sexual topic. For example a movie review site could be liable for discussing what type of sex scenes are in an R rated or even PG-13 rated movie. Simply showing a clip on your website from a PG-13 movie that shows a bare female breast would put you on the wrong side of the law.means any
