Actually from a legal standpoint, if there is no valid model release related to the photos, they DO belong to who is in them, and without a valid license agreement, anyone using the images can be sued not only for copyright infringement, but also using the person's image without permission, profiting from them (the person profiting from them can be sued for all the profit related to the use of the pictures, PLUS damages) and more.
