yeah, it should be noted his sentence was not for sending email itself, but selling fraudulent products.

He was convicted under a state law. There's many grounds for appeals. The obvious one is whether the constitutional speech protections afforded to junk physical mails applied to emails.

Unfortunately, it appears he cannot appeal based on whether the federal CAN SPAM Act superseded all similar state statutes due to federal supremacy on Commerce Clause issues. CAN SPAM prohibits proxy IP cloaking or fraudulent headers.

I haven't had time to really look at the reports on this case, if he was sentenced for bogus products/service, then the sentence could be reasonable to me....if only sending emails with advertisements for real products, definitely excessive in my opinion.
