    Client being threatened by HBO...

    I have a client who opened a night club here in VA called "The Bada Bing Of VB"

    He gets this email from HBO's legal dept. stating that he is in copyright infringement of the Soprano's show. They can do that? I mean, noone is ever allowed to open a club called the bada bing? Ever? WTF...

              Dunno, we used to have a Bada-Bing here in town and it was quickly renamed to All-Stars.

                  probably because it was on the show they patented the name.

                  There are many Titty bars across the USA that have the same name, but have no affiliation with one another.

                  Have his lawyer look to see if there is a patent .

                          Yeah he has his lawyer on it now. It is just BS that you can't name something what you want. It's not like people are actually going to think that it is the one from the show. Hell it's not even a go go bar...it's just a night club. I could see if he opened a hamburger place called McDonalds and had a sign out front with a big yellow "M" and served burgers called BigMacs. That is copyright infringement to me. But just naming a place something I didn't think would be such a big deal.

                          Oh well. Better him than me.

                              They've a Baba Bing strip-club in Pompano Beach (South Florida). I take it, this name is very generic in the club industry. Thus, I do not think HBO has a leg to stand on.

                                  If it was opened after the show first aired an episode that showed the clubs name then more likely than not your friend is fucked. Yes he could fight it, yet also remember HBO has lawyers on full time retainers that just fight this shit as their daily job description.

                                  If he opened it before the show aired then he would more likely than not be safe. Assuming the name was the same back then.

                                  It would be a hell of a lot easier to just change the spelling of Bada bing to badda bing or something.

                                          What about the restaurant East Side Marios... they use the slogan "Hey, bada boom, bada bing" on all their commercials.

                                          They were around a long time before the Sopranos. Maybe it doesn't apply because it is not the name of a bar. Who knows.

                                          Definately talk to a lawyer.
